So we do a short load with England,invoice it on 11/23/13. They paid a different carrier(similar name) and now are saying untill the other carrier pays them back we don't get paid. Bond company seems to be agreeing with that policy. All on a lousy 825.00 and we payed 175.00 unloading.

Ouch...that hurts! I think I would take that into consideration before hauling another load for them.

Bill the shipper.... Send it to collections.... Bond Company is wrong... If you have proof you hauled it n haven't been paid they have to pay you!!!! Have you contacted the company they said they paid????

The other question is was it England you were dealing with or a agent using there numbers????? If it is a agent I would be calling the main office.... Once you mention you are gonna go back on the shipper they will take a different approach with you.... First thing the shipper is gonna do is call them n ask them WTH is going on with this load.... We screwed n bad the wrong carrier is not gonna fly with them

I'm sure it will get payed (sometime) Just can't fathom the logic they use. (other carrier has to pay them back first)

I would agree with the thought of going first to the corporate office and then to the shipper. The shipper is responsible for hiring the broker and if the broker made a mistake,the shipper is on the hook. I would also get advice from a transportation lawyer. They seem to know what to do.

I can adjust guarantee what happened. It was an agent, they entered the wrong pay too in the system and that is who got paid. And England will pay you but the will charge the agent back.
The bonding company part seems strange. Does your rate confirmation have your company on it or the other one? -
Dealing with main office A/P in SLC. Wasn't an agent(3PL account) Just laughing that the"policy"is that the other carrier must pay them back before you are paid. The worse part is in early january we received a check belonging to the other company. It was scanned into the bank before we realized it wasn't ours. Called their A/P and then sent them a check back. Bond company doesn't cover 3PL work because they are just a "processing" center.

On a more serious problem with England(as a 3PL):
Had a direct customer for quite a few years that was bought up by another company. England does that company freight as a 3PL so that changed who we invoiced.(kept the same rates and acc).
Dropped trailer was loaded and at one stop(of 7 stops) the tempature was hot. All the other stops were on temp, so that stop was loaded hot. Unit was checked and downloaded, everything fine. They filed a claim for 13782.00 that was denied by the insurance(cargo doesn't cover shipper problems). We contested the claim and a year later they just took it out of a check. Refused to follow any claim procedures, just that the parent company shorted them so they shorted us. Never have had any proof that they were even shorted.(i do know that the parent company is claim happy so i'm pretty sure they were shorted)
There is no bond for a 3PL(a true one) Any court action is to the 3PL first and the motor carrier agreement(not broker agreement)will clear them. Then it's on to the parent company. Attorney fee's are more than the claim. And no you can't get attorney fees in a corgo settlement.
There are problems when you use a 3PL, liabilty is all over the place. If they use a broker agreement then you have a bond to go to, if a motor carrier agreement you will have to chase mutiple parties to collect. If they use both you really should have a confirmation on each load stating which agreement is in effect. -
A company screws me out of 13k+ I am not working for them-Anyone associated with them-anyone that sounds like them-looks like them.... Getting the picture... As far as the whole 3pl thing, what does that have to do with you????? You should be hauling for the brokerage side of the company..... The money they took out of another load why would you let that happen??? That load has clean bills-You have every right to every penny of that money..... I would file on there bond for that in a heartbeat!!!!
