Do the math... from 1am to 5:30am equal 8 hours ?? No.. so you are in violation if you drive.
If you start at 4:30pm you have to clock out at 4:30am.. if not then you have to follow DOT rules of a log book and fall under the Interstate guidelines of HOS.
If you punch out at 1am, you cannot work till 9am.

Ok reason I'm asking is because before new management we used to do a lot of charter work in the early AM such as 5:30AM-9:30AM run which was consistent for the school year(September-May). New management says the reason we don't do charters is because of hours of service. What happened is management created a 5:30AM-2PM shift so they would have a dedicated person to run the 5:30AM-9:30AM work and when done the run the person's other duties are cleaning and fueling the fleet of buses. When the school year is over the job entails other charter work during the shift and fueling and cleaning the fleet of buses.
What's happening now the department wants to abolish the 5:30AM-2PM job and go back to old way of filling run with over time on a rotating basis with the 4:30PM-1AM drivers. Our argument is that if you abolish a job and fill that job with OT then management is in violation of hours of service.
Another issue is when the current 5:30AM-2PM driver is out sick or on vacation the OT is offered to the 4:30PM-1AM drivers and some drivers accept it.
Another question there are other charter work at different times. Charter work we get paid a guaranteed 4 hours OT. If the charter is only 2 hours we can punch out at 2 hours and we will still get paid 4 hours. For a 4PM-1AM driver if we did a charter at 9AM could we still work without violation our regular 4PM-1AM shift?Last edited: Feb 23, 2014

Math -
You must have 8 hours between work schedules. You must be clocked out, not just sitting around and still clocked in.
You must have not drove over 10 hours in a 12 hour shift.
If you work over the 12 hour shift, you must go by Interstate HOS which includes logs.
You listed your hours, I listed the requirements as stated in the PDF which you say you have.
The CFR# is listed on the PDF. -
Just to reiterate....
There isn't wiggle room with rest time driving 8 hours even though the rule specifies 10 hours of driving(continuous). What's important here is the rule says you must have 8 hours rest after 10 hours of driving which I can live with because it says it what it says. However the rule doesn't specify how much rest after 8 hours of driving so it doesn't matter if you drive 8 hours, you still need the required 8 hours rest?
4:30pm-1:30am would be in violation if they performed the 5:30am-9:30am work

You are on a time card -
Limited to 12 hour days.
Limited to 10 hours of driving in that 12 hour day.
Limited to 8 hours of rest after your 12 hour day.
4:30 pm - 4:30 am = 12 hours.
4:30 am + 8 = 12:30 pm (when can work again)
4:30 pm (clock in) - 1:30 am (clock out) = 9 hours.
1:30 am (clocked out) + 8 (rest) = 9:30 am (when can work again)
This does not require a Cray computer. You look at the time you clock in, add 12 hours, this is when you MUST clock out. Once you clock out, you add 8 hours and this is your rest period. You cannot clock in early.
If you clock out early, you still add 8 hours. In your 2nd statement, if the driver clocked out at 1:30 am, add 8 hours, then they cannot clock in again till 9:30 am.
In your 12 hours shift you can do what you want as in wash the bus, refuel, etc, etc, BUT you cannot have more than 10 hours of driving in your 12 hour shift.
If you drive for 8 hours, then you still can be clocked in for another 4 hours of work. If you clock out, simply add 8 hours and this is when you can clock in again.
Put this on a lined paper numbered 1 through 24. Write in the time you clock in and then add 12. This is your clock out time. Add 8 and this is your new clock in time.
You keep asking the same things, but worded differently. Nothing changes in the rules for your situation. If you are not understanding these rules, you should have a safety department that should be aware of the guidelines that you should be following.jackfrosst Thanks this. -

Simply put it becomes simple. -
If you start at 4:30 pm and finally get off at 9:30 am that is a grouping of 17 hours which is a violation (see (a)(2) below). Your grouping has to be within 15 hours which you can drive 10 hours of them.
Local drivers just punch in and out. All time recorded is just on duty not driving. You need to have your employer fix your situation. You either have to take an 8 hour break between runs or change it to where you get off by 7:30 am or start at 6:30 pm.
State lines has nothing to do with HOS rules. 100 miles is 100 miles. -
I understand that. We NEVER work past our 4:30pm-1am schedule.
It was mentioned that I should talk to our safety director and I did. He said we need 8 hours rest. I agreed with him as it pertains to a 10 hour bus route and asked if that applies to an 8 hour bus route as well. He said that's a good question and he will get an answer, and I keep bugging him to see if he got an answer. So I decided to get an answer myself and keep getting transferred to people and departments from PennDot that can't answer.
I don't know if I'm complicating this or not but if there was written language pertaining to 8 hours then it would be less complicated for me. Another driver suggested since we drive 8 and not 10 hours maybe we can be prorated on rest time.

It says the first time limit is the 15 hour time limit. That doesn't apply because we never work 15 hours consectively anyway.
Then the second time limit is the 10 hour driving limit. That doesn't apply cause we drive 8 hours consectively.
