    So, by your standards since you only drove 8 hours, you feel the 8 hour rest period needs to be pro-rated? So, if I only drove 4 hours in my work day would DOT consider anything less than a 10 hour break - Nope..

    Once you clock out, you have to do a rest period of 8 hours... no pro-rating.

    Ok got it.

    Here's another scenario....

    Drive regular shift 4:30pm-1:00am, clock out at 1:00am, get 8 hours rest, report at 9:00am, work 9:00am-1:00am, clock out, report for my regular route at 4:30pm-1:00am.

    I'm assuming I need 8 hours rest after the 9:00am-1:00pm work since I clocked out?

    Got a definitive answer. I decided to call Harrisburg, PA State Police to see if they could provide me with a contact that could give me an answer. Didn't know this but the State Police has a FMCA Enforcement.

    Mark was pretty much correct. We fall under the 100 Air-Mile Radius Excemption

    As per enforcement officer...

    Must have 8 hours continuous rest after you punch out of your regular scheduled bus route.

    Once you meet the 8 hours continuous rest you can drive as long as you don't exceed 12 hours total. The 8 hours rest starts when you punch out.
