49 CFR 396.3 require carriers to maintain maintenence recods on all equipment they are controlling for more than a 30 day period.

Replaced my TPV in a rest area the other day. I knew it was starting to get buggy, so I bought one. Had a few minutes, so I replaced it. Never thought to log it as On Duty, although, I suppose, technically I should have.

I have had a good many inspections at weigh stations and randowm pull over beside the road inspections over the years, even had audits in my home when I had my own authority.
I kept monthly insections on my trucks and the leased trucks. I have never been asked by an inspector or when checked for logbook , to show where and who had done any maintenance on the truck or trailer.
the monthly report I send to my carrier I am leased to requires even as much as adding oil to be listed, and you also list who did it or any repairs, I put myself down on anything I do, they have never questioned it , nor checked to see if I logged it on-duty.
following the reasoning many of you seem to follow, anytime you clean the inside , wipe er down with armor all, polish the wheels etc. are required to be logged as on-duty.
if at an inspection you are getting asked to show on duty for a filter change, you are causing red flags to pop up. many times a mechanic even will note the date an air filter, oil filter etc has been changed, following the previously posted logic , one would also have to have the name, place and mechanics name and have the receipt on board to prove everything.
to me its creating mountains out of molehills, and is hysteria to the highest extreme. I can only shake my head, over and over.Oscar the KW, SL3406 and Steeleandsonfarms Thank this. -
