Insurance Claim Agent Demanding Log Book and BOL's

    Hello,

    I am dealing with an insurance claims agent and was wondering if anyone else out there had a similar situation or advice. My truck was involved in an accident through no fault of my own. The police report and eye witness will validate this. I'd rather not go into any more detail than that on the internet. I reported this accident to my insurance company and the claims agent has contacted me requiring my Log Book's and BOL's for an entire month prior to this accident. I am willing to provide the necessary paperwork for the week of the accident. However, to go back an entire month would require a lot more work. In addition to this the agent insinuated that he would be calling all of my customer's for his "investigation." Which I believe is going beyond his authority. Keep in mind this is my Insurance agent not the other drivers. Finally, after discussing this with him he agreed to 3 days prior records, but was quickly overruled by someone listening in on the conversation. Has anyone dealt with an claims agent like this?

    I have no problem providing specific records to the DOT for an audit, however this feels as if the insurance company is trying find a way to drop me from coverage.

    if your not at fualt and not makeing a clain with your company, i wouldn't think you need to provide your insurance company with anythign but the police report. They may want to see 7 days logs to ensure you were legal at the time, but 30 days has nothing to do with it. Are you submitting a cliam with your insurance?

    I would tell him that it is none of his business. All he needs to know is that you were NOT at fault. He has NO need to check your BOL, logs, etc., If he insists on having the additional information, I would tell him to put his request in writing and the reason for his needing them. You might mention that you will run it by your lawyer. I have had a couple of people hit my trucks over the years, but never had them ask for anything. Who is your insurance company?

    If you're running paper logs and averaging your driving times instead of actual driving times; that's probably what he's looking for. Also checking for time stamps on BOL's to match logs.

    File the claim against the at-fault party and there insurance company - leave your insurance company out of it. It may be a few more hoops to jump through doing it the way I recommended but it keeps anything from being on your loss runs which is what they will go off of when deciding if to renew you next year and at what rate. The requests they are making are out of the norm and it does sound like they are fishing for a reason to deny the claim.

    Id at the least tell them to put their request in writing stating the reason this information is required and advise them you will forward it to your attorney upon receipt. Once you do receive it, then consult an attorney.

    It could be much worse than that. Id get the request in writing and then consult an attorney, giving full details about the accident.

    Dont matter the size of the claim......

    We PAY the insurance agent for insurance..No where is it stated the Client Shall submit Log Books or BOL to them.....Thats None of their Business,

    Their Business is to Get your equipment Fixed without controversy

    I would NOT povide anything to them........
