I'll be willing to bet it wont go anywhere since I believe most truckers are not covered by the Fair Labor Standards Act.

So what this lawsuit asserts is that a employee must get paid for sitting when he only gets paid for the miles he drives. Gee, what a concept, but the way trucking has been paying drivers for the past 100 years, I doubt there would any substantial compensation involved other than the accumulated lost wages as the driver sat. The catch -22 is the driver daily log. This business of recording hours of service with a E-log could essentially destroy any argument that the driver was working unless he actually logged on-duty not driving as he waited for his next assignment or sitting at the shipper or receiver. I have no doubt that some drivers are being subjugated to the point that they quit so the company doesn't have to "fire" the employee without just cause, which certainly would qualify the driver for unemployment benefits.
Conclusion: If you are working out on the road and making less than minimum wage, you should seriously consider looking for a better paying job. -

the lawsuit has nothing to do with the overtime laws. it is about federal min wage.

I got my letter on the lawsuit back in July on the 28th, 2015. I was never paid my hourly pay or of detention pay for sat on a load for over 3 days at a receiver due to paper work for the load wasn't given to me for the mail distribution center. The company paid the detention pay but I didn't recieve it so when I called the law firm on things and told them that...it has made them interested in me to FedEx my pay stubs and my load papers I still have from transflo so to made sure I was paid for all my loads..to FedEx them to them to look over for see If I was paid or not. I haven't yet cause of I was treated good there even though got let go after 3 months..they even paid my way home from PA to NC and of been sent a email to me of a rehire ad and I did look up to ask on things and was told to call but I haven't yet. I'm planning on to to see if work out a deal for rehire. I have no complaints about them other than that detention pay I never got paid and of lack I only got a 10 hour home time on a saturday instead of the should had been a home time of 3 days after been there for over 2 months without got home until that 10 hours.. I would love get drive back for western express even if they don't have apu units or inverters for to use a microwave or other cooking appliance and a fridge in their trucks like other companies are doing to try retain drivers..I rather have these 3 than a tv with direct tv. I don't watch tv at all. I look at weather on my cell and chat with family and friends.
