Is it legal to make driver to pay for preemployment drug screen?

    Recently, I applied for a CDL Driver position with a NY based employer. After successfully passing a Road test they are sending me to go thru physical examination and drug test to their approved medical office, and it says at the paperwork they gave me " Driver is responsible for payment - $110. " And they said it's a company policy. By the way, I have my own medical certificate current (which expires in 10/2014). So, my question is- is it legal for them to make prospective employees- drivers paying for their drug/physical test, regardless of a result of it, without any reimbursement later? It could be legal in some states and illegal at some other ones, but I really want to know how is it in NY.

    I believe its legal and your company should reimburse you.If they're that cheap not to pay for it then why would you wanna drive for them?

    yeah, what Patty said. It's perfectly legal, but I've had 2 companies try it; I laughed and hung up. A lot of jobs out there driver...

    I hire company & O/O drivers, I don't charge anyone for a drug screen but they do pay for their own physical (because they can take that to another job). If you have a valid physical (including the long form) I don't see why they won't accept that. Of all the trucking companies I know of none charge for drug screen. Sounds like they're broke or cheap, or both. I'd take the next company. There's a shortage of drivers right now, you're in high demand.

    That's Bus company... when I'll check some others I'll see whether it's common for bus companies.. obviously, they don't have as much need in drivers as trucking companies do - there are lots of class B bus drivers drivers who never been in trucking business, and they'd rather pay for it to get a job that'll enable em to sleep at home every (or every other) night...
