    Notification Period

    With three exceptions, notice must be timed to reach the required parties at least 60 days before a closing or layoff. When the individual employment separations for a closing or layoff occur on more than one day, the notices are due to the representative(s), State dislocated worker unit and local government at least 60 days before each separation. If the workers are not represented, each worker's notice is due at least 60 days before that worker's separation.

    The exceptions to 60-day notice are:

    (1) Faltering company. This exception, to be narrowly construed, covers situations where a company has sought new capital or business in order to stay open and where giving notice would ruin the opportunity to get the new capital or business, and applies only to plant closings;

    The lawsuit means nothing except a lawyer getting free publicity, they are filing Chapter 7 and there is nothing to give anyone anyway as the secured creditors will not even recoup their loses but even if there was something left over closing due to unforeseeable circumstances like financing falling through is exempt from anything in the WARN Act.

    I've beat the dead horse into dust by now but....i wish that drivers would stand together and we could change all of this. Then we could see to it that the laws ( and much more ) were changed so that when this happens, drivers are not left stranded thousands of miles away from home with no way back.

    But doomsday will happen before a driver will stand with their brothers and sisters to effect change.

    What are you talking about??? There are no drivers being stranded thousands of miles from home. All of the equipment is being brought into terminals according to landline.

    Yes they are. They want you to return the equipment to NJ. Then you are on your own. If you live way out of state and dont have funds you are SOL. Dont make it sound like they are helping drivers. They DONT CARE. And even when on a load THEY DONT CARE. Matt the outbound dispatcher quoted in the story is already gone.

    1500 people out of work, over 1000 of them drivers, who are from all over the country and many have to go to Jersey to turn their trucks in as you said. 1500 people now with their lives in limbo because of the incompetence of the big money people. I don't feel for the CEO and the other big wigs of New Century. They did this and they should be responsible for getting these people home. They'll drop them off at a bus station. The ####### nerve of these leeches in three piece suits.

    No, Arrow stranded drivers around the country. Having you return equipment to the home terminal just like you would if you were quitting is a far different scenario. I don't have a dog in this fight, and it suck that New Century went out of business, but it's far from a disastrous irresponsible situation like Arrow was where drivers had to turn in their equipment to the nearest truck dealer to their location and figure out how to get home from there. You got to orientation in NJ somehow, you can get home too.
    If you look back in some of my posts over the years, I 100% recommend hiring on with a compNy that has a local terminal, or one within a short drive. It makes the travel to orientation far easier as well as the seperation when you leave.

    I dont see any difference. The drivers that are SOL are the road drivers. The locals parked their cars at Westampton or Willingsboro. The road drivers are the ones that are screwed. People got to orientation by the company paying their way as do all companies. If you live in Colorado and have to return a vehicle to NJ and then find your own way home how is that any different than if you worked at Arrow (back in the day) and also lived in Colorado and say were in Texas at the time and had to find your own way home from Texas. Same ######. Same scenario and same outcome. Driver is STRANDED.

    Yes it is always better to find a company with a terminal close to your home but again thats really more important for regional/local drivers since they come home more often. If you work 3 weeks on the road at a time 99% of the time it really doesnt matter where you live as long as the company gets you home when you request it. Obviously NCT is the 1% where it does matter.
