Ok i started this job in arizona. Its a team operation but unfortunately the partner the job placed me with is a heavy smoker. 2 packs a day smoking in cab etc. Nobody else at this job likes riding with this person because of his smoking but yet the dispatchers wont do anything because he's a good employee. Me im a light smoker but i dont smoke in cab or in closed doors etc because i get light headed. Ive asked several times may u place me with someone else because of my discomforts and they wont. There response is they have to hire somebody else but theres other people they could team me up with they just dont care. My job is already hard and on top of that when im in sleeper birth trying to get the little rest im allowed im just inhaling nothing but second hand smoke which is making my already little rest even more harder. Can i sue for this???? If so please let me know who to contact. Or do i just ger anothef job, i could be wrong but i dont feel that in order for me to recieve a paycheck i have to complicate my health conditions in my future. Like i said several attempts have been giving to not be placed with this individual and they dont care.

The problem I see is that you said you are also a smoker would be hard to make a case about your health if you smoke even if it is lightly. You could however quit smoking I think if you could accomplish that they would have to find you a diff person to team with

One possible solution is this: Quit smoking altogether yourself and THEN request a non-smoker. If that does not work, you may have to look for another job. You only have 1 pair of lungs. Take good care of them.

    Good luck to you.

Take a look at the below link to give you a idea of what legal options you may pursue. You do have many options. It is just a matter of whether or not you have the stomach to pursue them after just starting with this company.

If the cigarette smoke is bothersome, place one of more plug in ozone generators in the truck and it will destroy any smell of smoke.

Has you co-driver ever considered using electronic cigarettes instead of the real ones? Many brands here on the market from companies like White Cloud and Johnson Creek to name a few make some really good products. I switched to them over a year ago and really like them. They are also much cheaper too. No cigarette smell in the truck or on your clothes is a plus.

Just so i am clear, your a smoker that cant stand cigarette smoke and get light headed from it ? Oh and you want to sue ??????????????? Yeh good luck with that.
Oh and if this is for real , as others have suggested ....you could quit ...and i don't mean smoking.

I think your best bet would be to slowly increase your smoking tell your puffing 2 packs a day and then you wont even notice it when he is smoking. Oh and the dizziness should go away after your body gets adjusted to it.
