had a driver picked up 3 partials 53' step deck total 45000lb
the upper deck was 6000 lb, lower deck one of the loads 12000 lb (took 15ft) and last load on lower deck 27000 lb a forklift took (18ft)(rear of the trailer)
driver was fined for $1200 in st Clair MO weight station for over weight in the rear axles ????? he slided the axles before he left the shipper to be safe
is there anyway to dispute this without court? paying to a lawyers and court fees will cost me about the same money ?
    thank you
    i am shocked $1200 wth

I would love to see the scale ticket on this. .. I am going to assume that the driver didn't scale the load before going down the road to far.

I've not seen a step deck where you could "slide the axles". But yes, with a 27k forklift near the rear in addition to the other stuff, he was heavy on the trailer. Was this a spread-axle? (not that that would make much difference in this case but would have reduced the fine as opposed to a non-spread axle

Should of loaded forklift towards the front not the rear. If he would of scaled it we won't be having this conversation.

53 ft steps come in two styles, one like Swift uses to avoid the bridge law troubles (they have the 10 ft tail swing past the spread) and the other type with the spread at the rear of the trailer. This type, you have to close the spread to be legal in California and Florida, or get in deep bridge law doo doo. Both are quite eas to overload the spread, the difference will be how much. Set that forklift on the Swift style, BEHIND spread, and you are wayyyyyyyyyyyyyyyyyyyyy over. The other type with the spread to the rear is deceptive, and more difficult to find the center to load, but had the sliding axle to close the spread into a tandem for the bridge law lovers.

Even so, as okie said, if your driver had put the heaviest part of the load to the middle, preferably against the step, you would not be having this conversation. Your driver doesn't know enough to be running partials. Try calling the courthouse and beg them to reduce it.

Or tell your driver that you wish him luck with his ticket.

If you fail to scale out, you really have no room to complain about the ensuing ticket.

Failed to scale and now you don't understand how this happened? Sliding the axles means nothing. Well, at least you got some real world training and a lesson. I wonder how stable that trailer is with all that weight back there...Pay the ticket and move on. I don't understand why this post is even here.

I'm assuming the fork lift may have been driven on, and that is why it was put on last? Learn from it.
