Your insurance company can drop you at anytime it wants to. If you are involved in an accident with a covered vehicle. Serial numbers match what is listed on policy. They have to cover the claim. They may drop you from future coverage, but your current accident would be covered.

Thanks for all the replies. My main concern was him doing this before the insurance has settled and not telling the imsurance co. he's putting it back on the road while it's under claim

I don't think you have anything to worry about there. They pretty much don't care what you do with it while you are settling the claim as long as they can get their mitts on it if you decide to NOT retain salvage and let them have the truck; which appears not to be the case since your partner is gonna run it which means he repaired it. So clearly y'all intend to keep it. Think about it as a "money trail" because that is all it is to them.
If y'all want the truck and are gonna accept their settlement of ACV minus Salvage they don't care if you run it or use it as the starter for a bonfire. It's a done deal to them. Your truck. Do what you want with it. All you'll have to do is jump through whatever hoops the adjustor at the insurance company needs to close it as far as a salvage title being in place before cutting the settlement check. No worries. Motor on as long as you feel good about how well it was fixed. You should be able to get your settlement check without too much hassle title wise. Just some PITA paperwork but I don't see anything that would concern me otherwise if y'all are happy with the truck as it rolls. Insurance company adjustor will probably be happy about how everything worked out. He/she won't have a big chunk of scrap iron they bought to deal with. You bought it so he doesn't have to deal with getting it to the boneyard. No disrespect intended by the term scrap iron. That's the way THEY look at it but WE look at it as our TRUCK. Just sayin'

Last Thursday afternoon, a couple of teenagers basically ran a stop sign in Kansas, I veered into the left lane to attempt to avoid, but no luck. The car took out the right side of my bumper on my '16 western star. Also tok out the bottom of my radiaqtor, CAC, oil pan, moved the right side of the steer back about 3-4 inches, caved the right fuel tank in and dented my APU cover pretty good. I am buying this truck from a private party who is making payments to Benz Finance (declared as loss-payee). I'm in a motel in KC, KS. My question is, can I expect an offer of another truck, should the truck be declared totalled? I realize Benz will be paid as loss-payee. The gentleman I am (was) buying it from only wanted someone to get the truck paid off and wasn't interested in getting anything for it. So...All that being said, Do I have any hope of being offered another truck, or will the insurance company pay Benz off and call it good.
Oh, I wasn't cited. The trooper said she could see where I attempted to avoid, and, if I can ever figure it out, my dash-cam was working at the time. I don't know if any of the last sentence would have any bearing one way or the other. Thanks for any info you can give me.slow.rider Thanks this. -

I would try to negotiate with the insurance. Explain to them that I’d rather fix it myself, and avoid a salvage Title. Assuming it’s a nice Truck. On the other hand, if you’re going to keep it forever, and think you can get a considerably larger amount of money now. It’s up to you. I wouldn’t fix it, till the bids are in. 98, you never know. Lots of others will see it only needs a front clip, bids may go higher than normal right now, might just be exactly what someone needs, or is willing to repair. Too risky. Insurance will probably want the bids anyway, to determine their exact liability. I personally would try to make a quick deal, maybe they’d rather close it out. I’d offer documentation of repairs. And even if not required, I’d keep a record/ pictures for proof. Anything to avoid a salvage title. A friend of mine totaled his Truck. after just rebuilding the engine. Got the payoff, bought it back, ended up with almost double what he had into it. He got salvage title, fixed it pretty cheap. Put a Driver in it, after a couple weeks, Driver wrecked it again. Insurance wouldn’t pay to fix anything, since it had already been salvaged. He fixed it again, and just started running it while rebuilding his Truck. Up till now, he’s made more money off the Truck from the wrecks, than from running it. Lol. Now it’s definitely worth more in parts, than for sale, with a salvage title. Fresh 99 12.7 etc.

Who actually owns the truck? You or the guy you plan to buy it from? By the sound of your post its not yet yours and it still belongs to the guy who's paying the note to Benz. If my above read of the situation is correct you might not see a penny.
