I don't understand why a very few posters seem so embittered when it comes to drivers who choose to work on a 1099. Like RedForman says, it is the drivers decision as to whether he accepts the position.

I'm not embittered about it. But when I see it going on it's usually beneficial to the company paying that way but not to the driver. In the case of expediter cargo vans it amazes me that anyone would waste the effort of working for essentially nothing with those 40/60 or the 60/40 splits. The rates are already terribly low to begin with due to over saturation of equipment and this is how they can race even further to the bottom. For a big company leasing on lots of the small cargo vans it works out great for their bottom line. They're competitive on rates and not dealing with the overhead of trucks. Even drivers I know of around here in big trucks it was the same situation. You may have been different and allowing them to get 80 cents a mile or more but you would have been an exception. Most 1099 pay to hired drivers is obscenely low and that way cause it's easy street to cut throat.

I get a kick out of those who call someone paying on a 1099 is not operating a "legit" business. If that is the case then every carrier who leases trucks to their drivers is not operating a legitimate business? People make their own decisions. You don't need to belittle those who "CHOOSE" to work under a 1099. It is their choice. They don't have to work under a 1099. They choose to work under a 1099. Perhaps it is the additional freedom it can afford them or some other reason. Companies who offer 1099 positions are just as legitimate as those who only offer a W2. I know some of you who don't like anyone working on a 1099, but there is no need for the name calling or putting down those who choose to work under the 1099 or the companies who offer this type of position. -

I would like to say thank you. Thank you very much to all of you for informations on 1099 & W-2. After all my research in the last two weeks I have decided to pay my first driver W-2. I find out that lots of fleet owners pay they drivers 1099. Looks like I'll be one of those who will pay drivers W-2 but at least I will not lose any sleep overnight what may happen tomorrow and how much penalties and finds the IRS will possibly give to my s-corp.
Yes...1099 it could be so much easier and cheaper for me, but I cannot take that risk.
My only question is what the heck is going on in this country? How come somebody can pay they drivers 1099 for years or even a decades and nobody say anything? So far I was not able to find any answers for this.
Actually I did .... my only answer is don't ask ..... don't tell polices. Sad but true......

I happily report 1099 companies to the IRS. Tax cheats deserve what they get and if I ever see a 30% award, all the better...

That's very nice of you and I'm glad and proud what you do for this country...
But don't you worry that you may be hunting down by third-party -
I worry more about competing against tax cheats & their artificially low operating costs.

A company who pays on a 1099 is not a tax cheat. The person who is paid on a 1099 and fails to pay his taxes or later tries to push the blame on his former company is the tax cheat. I hope I cleared that up for you.
