Advice for seatbelt ticket!

    OK, now I'm officially having a hard time believing you. The DOT cops name is on the ticket he wrote you. And I'm pretty sure you had to have the ticket in front of you when talking to the DA's office about it, so you could give them the pertinent information ie, ticket number, date, time, location, charge etc.

    Well, it's a good thing they passed it because I was about to put on my Cowboy hat, run through there with 2 colt .45's screaming Ahhhhhh, you'll never take me alive!

    Hey wait a minute. you guys are wrong about having it on when moving the vehicle.

    Almost all states that have a primary seatbelt law that is pretty much uniform in its wording, here is an excerpt from Michigan's law - each operator and front seat passenger of a motor vehicle operated on a street or highway.

    If we are to believe that we are supposed to have it on even to move the truck from say the fuel isle to a parking spot or better yet from my drive to my garage, that opens the driver up for frivolous tickets by cops that could be construed as harassment.

    When instructed to move a vehicle that is not on the road, but in a closed area like a scale for inspection, you don't have to have the seatbelt on. The AG was right in an immediate dismissal of the ticket, the officer is wrong in writing it. The Driver was following instructions of the officer and in doing so did nothing wrong.

    We didn't say the driver did anything wrong.
    But this is an age when the word of the day is CYA, in all situations.
    For just the reason that there are troopers our there who will write tickets just like this. So they can justify their piddly government salary.
