I have joined a company that was not tracking its BASIC scores and now that we see them, it looks like an audit is right around the corner. We are a small operation and we are trying to do things right. There are so many things to keep up with aside from the workI would really appreciate some assistance.
One of the o-os leased on to the company had an accident last week and someone had to be hospitalized. I am so so happy no one was hurt and that person is now out of the hospital and doing good. Its the first type of accident in company history but there was a second one this year that would be noticed or recorded by DOT. The first one had a vehicle towed. I feel the driver is not at fault but thats for lawyers and judges to decide. My job right now is to prepare for a possible audit.
How possible is a audit??? Our hours of service basic does not look good, its past the intervention mark. It seems to mostly be just from filling out log books incorrectly. Would a auditor gives us any slack there if its not an actual break of the hos rules, like driving too long?
I am trying to just prepare and be professional and get things in order but where do I really start? I have some things in order at least. Which of these should I focus on??

Also, can someone clarify this? The driver received a ticket from the accident and online I found that he should be tested for drugs and alcohol. The problem is that I didnt find this out until several days after it happened. Are we going to be fined for this? I need to talk to the owner about giving me a raise.

What's your MC number. I can look you up and see how your doing. It's not called an audit, it's called an intervention. As an example. If your trucks are being written up for maintenance issues they will want to know what your going to do about it. The owner could say he's going to have every truck gone over by a dealer and fixed. As a follow up the DOT may show up later on and inspect every truck. Or, drivers speeding. They will expect the owner to fire them and hire new drivers. Stuff like that.

Company I worked for got an intervention inspection after 35 years in business. A letter was sent with date and time of inspection. It also had a list of everything that was needed for presentation for the inspection. Some of the things it included were: logs, DQ files for all drivers, maintenance records for equipment, the random drug testing procedures and results. They didn't inspect everything but rather randomly picked things out of all that. When all said and done, we got a statement of things that needed attention and a pat on the back. If the 1st inspection didn't go well, they would've came back after a period of time for a follow-up. I'm sure there are a lot of things they'd want to look at but that info should be provided ahead of time. Keep your files in proper order, audit yourself and if you can pass that, then you'll be ok.

Part of being in business is knowing the rules and MANAGING your business according to those rules. There really is no excuse for not knowing your driver needed a post accident drug test. You may or may not get an audit but I'd say the drug test issue is going to be a biggie. Also, if you've got problems in the HOS/Fatigued driving basic I'd start shopping for EOBRs because you likely are going to be forced to use them.double yellow and bigdogpile Thank this.

Well. They will often let bad scores slide until something happens but it seems like that something has happened so I would say you might well get a visit. The company should take the position that they wanted to be pro-active and therefore you were hired to come in and clean house. As for not having the drug testing done....that could be a problem. Best thing you can do is get everything else in order and maybe they will let you slide. Hope for the best but prepare for the worst. They might well yank your authority.
Your boss might want to look into finding a backup plan for his trucking needs. Maybe there is someone within his company that can sever ties with the company and create a new arms length trucking business. This new business will go through the new entrant process and do everything correct from the beginning. That takes time so start now. -
Not properly filling out the logbook IS a violation of the HOS rules ...You may get a break but depending on who audits you maybe not

Ok thank you. I did read that they should give you a call or notice ahead of time but also read they might not. Which of these 3 sources would you go with to start preparing everything ahead of time?

I agree, if you are in business you need to know everything. Its unfortunate this stuff was not taken care of before, I'm not doing the best job possible or trying. Do you know if I would need a EOBR if we switched to electronic log books?

Ok, we will be holding a training class for drivers so properly filling them out wont be a problem in the future. We are also allowed to correct fill out mistakes on previous logs no?
