Ok I have a question concerning o/o pay. How can they take out child support our of my check when they can't take taxes out? I already lose half of my retirement, now I'm losing even more. Don't get me wrong I'm not trying to not pay. I've been paying for the last 10 years.

Ok well i guess I'm screwed. Still can't afford to get a lawyer with this being taken out and not getting the loads i need. This sucks.

Sound like you have an ex who has an attorney on retainer to make sure to know where you're at and working, at all times. They wouldn't have to withhold the money if you voluntarily paid it directly to your ex every month, and stayed current.
Child support and 1099 earnings are 2 entirely different things in the view of a judge somewhere. -
Maybe I'm just trolling but I can't stand to hear anyone gripe about paying child support

I've been doing that for many years. The problem started when i retired and tried to get it changed. I couldn't afford a lawyer then and really can't now. Also if i wasn't overseas fighting a war i could have been in court and this wouldn't have been an issue. But thanks for the comment

Ok for those who think I'm just trying to get pout of paying child support, I'm not. I was paying $1,700 a month. I was also sending my oldest at least $300 a month to eat while she was in school and bought her a car, which i was told that neither counted toward child support.

While not exactly a legal answer, why don't you ask your payroll dept at your company for a copy of the "order" or papers they received from the state that "ordered" the deduction. More than likely it is some state agency with a phone number on it, call them, and see if you have any options. More than likely it is legal and your options are limited but it may be worth a shot.

You're not "trolling". The OP HAD to know if they posted a question of this nature, there are gonna be responses that they are not gonna like to hear.
If a person takes the time to 'make' a child....they SHOULD be held responsible in EVERY aspect of that child's life. This includes financially. If you, for ANY reason, or no reason at all, do not support your offspring voluntarily...the Government is there to make sure you do any way---and THANK GOD for that, because as a tax payer, Father, and Grandfather...I am happy to pay for MY family, but sick to death of paying for everyone else's as well.
Now; on a different note. There IS such thing as being held to pay TOO MUCH child support, to the point where a person can barely make ends meet with what is left of their check. Some of these court systems think a person can live on one third of their NET pay...and from what I've seen for examples in my friends lives, it is ridiculously impossible. In the eyes of the court, children come first, custodial parent comes second, and you can rot in the streets. Needs to be looked at a lot closer in my opinion.
OP; pay what they say...there is nothing you can do about it other than quit working all together and become a "Dead Beat Dad", like so many others (men AND women in this day and age). Be a part of your kids lives willingly and not forced.Numb, superpet39 and pattyj Thank this.
