Virginia enforces the 2 hours limit,,the ticket will be for "failure to obey a highway sign" they want to burn your drivers record,
In 1999 I traveled thru WV in to Va on I-64..got to the Truckstops on I-81 in Raphine Va about 1130PM could not find a place to park so I head back out on I-81n to I-64e..Got to the bottom the mountain on I-64 and found an open truck parking space in a rest area about midnight,,went over my hours about 45mins. Four hours later a VA trooper woke me and 8 other truck drivers up and wrote all tickets and ordered all to leave,
Told the cop I was in the middle of my 8 hour break and out of hours,,He told me I had to leave,,I told him I was too tired to safely drive and he told me if I did not leave he would arrest me and impound my truck.
Next day I called the commonwealth attorney's office and was told they would prosecute .
When I got home that night I contacted the Washington Post Newspaper and told them what happened, the reporter did not believe me but said she would look in to it,
A week later the reporter called me and said she verified my story. The next day the reported and a photographer came by took pictures of me and my truck, The following week in Nov 1999 my story and picture was a front page news story in the paper.
I filed a formal complaint about being forced back on the road after telling the Va State Trooper I was out of hours, too fatigued to drive and that I could not find an other place to park.
I got calls from brokers and others all across the country from people I know telling me that the story hit the wire services and newpapers everywhere
I got a letter back from FMCSA telling me that drivers need to follow all hours of service regs and that driver fatigue was a serious issue but "Virginia could do what ever they wanted"
You have to understand Virginia, after all they were last last state that thought slavery was OK.
Yes Virginia still enforces a 2 hour parking limit and the ticket is a serious violation,,the FMCSA is really not interested in truck safety,,If trucking was safer they would all be out of workscottied67 Thanks this. -

I spoke with a trooper in Virginia at a rest area and he said as long as you were in a legal parking space you would be good for your break. Did say two b&r limit still existed but that you wouldn't be bothered. That was last year I talked to him.

Virginia is horrible state. I've seen VA state troopers write the time on truck tires with chalk. Two hours later if the truck is still there, the driver gets a ticket and a lecture from some scumbag cop.
I was making a delivery in a small town in VA; load of guard rails to a new road project. Couldn't find the place because it was about 2 AM. No traffic, the town was asleep. Saw a convenience store open so pulled on the shoulder with plans to ask about where the new road is being built. As I walked toward the store, saw a cop car parked there. The cop saw me and came running out of the store screaming and had crumbs of food spewing out of his mouth. I asked where the new road is and he screamed,"You can't park there, go find a legal truck parking spot and then I "MIGHT" answer your question." He kept screaming and eating food and spewing food into the air. Saw a dairy across the street with delivery trucks parked in front, so parked with their trucks and walked inside the dairy. Told them what happened and the guy said, "Welcome to Virginia." He told me the place I was looking for is only about a 1/8 to 1/4 mile away. He pointed South and said, "It's right there on the right." He said everyone in this town hates that cop and hates the whole police force because they're all just like him. He said, the way I was treated is what the local people have to deal with every day. -
You should be good driver. I just called the cops and DOT and told them you were there in clear violation of the 2hr parking limit, and they hung up on me...Cranky Yankee, BigJls1, scottied67 and 7 others Thank this.
