I agree with the fact that in most cases a driver on a 1099 is really an employee. Just that you can have a degree of control on a (sub) contractor. "Training" a contractor to do a job wouldn't make them an employee. Nor would requiring them to pick up/deliver at a certain day/time. Providing a fuel card, routing, fine. If requiring it not so good.
Federal regs prohibit "you" from "working" for anyone you choose while under the carriers authority.

In addition to the WSIB, EI and health ins that was mentioned by Cat, the employer will often infer that the 1099 employee will "take more home" because of all the glorious tax deductions that he/she is allowed by virtue of the 1099. The idea is more deductions means the employer can pay less. To use your example of $50,000 gross, the employer might only need to ay $45,000 for the driver to have the same take home pay. They can also say, I'm paying you $50,000 either way but you will take home more if I pay you on a 1099.

Well actually.... a long time ago I was 20 years old. Long story short I was working on a 10-99...I did this for 2 years, and paid my federal & state taxes....Well I got a letter from my local county....That's right the county I lived in said I owed them money! Because I was being paid with a 10-99 & I did not have a contractors licences with the county(as in you live in the USA, You live in a State in the USA, In this State you live in a County) I owed back taxes to to county I lived in.....Renumber I paid my fed, & state taxes....Noone ever said d*ick about having to have a county business licence just because i was paid with a 10-99??? Live and learn.... If you live life as a entrepreneur like myself don't forget your "local government" "God Bless The U.S.A. your State & your good old "local Government".... So you have 1)Uncle Sam, 2)His Brother Luther, Then 3)I don't know Your other Uncle's Brother's Cousin for your mother's side getting there "cut" to.... My optionion No matter how you add the number's weather you preferr w2, 1099, ein, ssn, whatever 50% that's half of whatever you make some how, up or down, left to right, upside down, inside out, north or south, east or west....I'm saying half go's to taxes one way or another, payroll, medicare, fuel, food, service's, every dollar you make then every dollar you spend with go back to the goverment by way of tax.....This pays for federal militiary for defence, State roadways, & local goverment funding like schools, all most all no less than everybodys earning's go back in form of paying taxes(problemly more than 50%)....w2 just has less paperwork for the worker.... Who likes paperwork???
W-2 workers in my opinion are more disciplined they follow "company rulrs written in stone" & a 10-99 worker normally has more freedom as long as there following guide lines to keep there customers happy & not breaking any laws the rules are written in pencil and reprimand is on a case by case basis. W-2 employees get unpaid time off as disaplin where as a 10-99 worker is more old school and still gets the old fashion beat down with no time off at all???? Your either a worker or a owner! Cowboy or Indian! or does it go Cheifs & Indians....Whatever however.....Is there really that big of a debate over which is better w-2 or 10-99? -
I believe this is true....However your company has to have more than i don't renumber how many employees.... I think the number is like 3 or 9 it's under 10 for sure... and yes once you reach that magic fed number that's true.....I'm not a lawyer don't take that to the bank! But I am 99% sure 1st your company must employee "X" amount of workers

If you "earn" money as in "TURN A PROFIT"....I can guarantee you will always owe money in taxes to all government anglicizes that collect tax money & then some you probley never even heard of....If your not a good Business Owner and drive your company into debt....Drive it into the ground....As in go bankrupt, as in invest countless of your personal dollars probley even borrowed money like business loans(truck note's, etc) into your company and still manage to loose money....as in how did you ever even have the since, like how do you have half a brain to even know how to start a company....You may as in might not own federal taxes, more than likely you still owe state & local plus things like permits, dot number etc.....again im not a lawyer, don't listen to my opinion's....but rule of thumb....You gotta "PAY to PLAY" starting any business is like rolling dice, actually that's the stupidest thing I heard starting a business should never be like rolling dice...

That would be exactly what I'm going through. I'm as good a risk as anyone will find. Got my CDL in 1978, I have great credit, immaculate driving record, have driven in all conditions in all 48 states. I have pulled just about everything that can be hauled, except for livestock and produce.
I left trucking in 1999 to work on Tugs, Worked my way up to Captain in 2004. Became aware of asbestos that the company had paneled over so that we didn't know it was there. They tried to deny that it was getting airborne, I got pretty pissed of because that crap could kill me and my crew on the Tug Cape Henlopen. This was in August of 2014, and my career fell apart on the Tugs because I wouldn't be quiet about it. Moran Towing, fired me and black-balled me in the industry. I had my life mapped out all the way into retirement and having a comfortable end of the ride. But no, greed and arrogance, threw me away like a piece of toilet paper. Bunch of douche bags and I hope karma is sharpening her claws to devour them when the come for judgement day.
So now I can't even get a decent job driving because I don't have any recency.
I have money to buy a truck but no one wants to insure me. I have fantastic credit, my home is paid for, I'm old enough that no-one wants to hire me, but to young to retire.
I can do heavy haul! Where and what do you guys haul? Not to interested in going to heavy, but 7-8 axles would be something I could handle. I think I could be content running about 10-12 eastern states until my mother goes in the ground. Then I would be okay to run all 48. Matter of fact I kind of like the challenge of running coast to coast across 90-94 in the winter, Lol..
