So some quick help with HOS

    I don't drive in absolute fear of having a wreck. Everything in life has risk. I choose more hours to run over the incredibly small chance of a drunk hitting me. Plus, in your scenario I'll take my chances with a jury, drunk driving isn't too popular these days.

    I know you're just trying to get it right on your own, but this is something your company should be watching and explaining as well.....especially after your first week and running that hard.

    The fact that the guy who hit you was drunk may be inadmissible during your trial for falsifying your logs, because it is irrelevant to the fact that your logs are, indeed, false. Only if the prosecutor decides to go afterr you for vehicular manslaughter would the other driver's drunken state be considered as a mitigating factor. You were still in a place you should not have legally been, and therefore still stand a good chance at being saddled with some of the blame.

    I could be 2,000 miles away and the Chinese could invade my street but again I'll take my chances.

    There are what roughly 3 million commercial drivers in the U.S. Can you find me say 5 stories of drivers who had someone hit them, then had their logs inspected, then had an investigator call up the shipper and ask what the driver was doing while being loaded, then confirmed he was supposed to be on duty?

    My point is worrying about that is like worrying about a sinkhole swallowing you. In fact, I bet more people have been swallowed by sinkholes then had anything like the scenario you made up happen. Now, if you want to log that way and burn your 70 then great, it's your truck. Me, I'll take the money.

    They can also argue that you would not have been there had your logs not been falsified. May not be criminal court but civil court that would be a valid argument.

    Incorrect as of the day 8...he would have 4 hours coming off at midnight of 7/1 going into 7/2. At midnight 7/2 into 7/3 he would be getting the 10.25 hrs from the 26th....so on and so on.

    My recommendation; stop before noon or 1400, sit out the 34 and start running again at 0015 taking only the one complete 24 hour period off. It gets you the 34 from the 10 (+) hours and the 24 ending at midnight the next day. That 4 hour day is a killer to anyone trying to utilize recap hours.
