Trucking employer keeping my last two checks...

    Some of that should be imposed on the parents too. We have a guy that works for us that I swear his parents were related before the wedding.

    File a complaint with your local labor board and file a small claims court case for the money owed,,unless you signed an agreement to pay for damages it is against the law to hold back your pay,,Did the employer with hold fed and state taxes and Social Security? Tell everyone who the employers is ,,it is useless to complain unless you will identify the company,,

    Tony I know that this sucks, but you may have signed a document when you hired on that stated that they could hold upto x# of dollars out of your final check if the equipment was turned in torn up or filthy. We had to have our lawyers draw that up to protect us. Before any of you start saying that I and others are ripping off the poor little driver, you don't know how many have come in and torn stuff up and left off to another job after lying that they did not do it. Tony I don't believe that you are one of those kind of guys, you tried to make good on your damages. As far as being able to hold back $$$ they usually can hold back ( if you signed the agreement) up to the deductible on their insurance, and any cleaning fees associated with cleaning the truck. Anything else would be extremely rare and most generally you may have a case. As far as how long they have to pay you the final check. By law they have between 14 days and no more then 45 days after terminations to settle with you on any monies owed to you. Sorry that this sucks but that is the way it is.

    There should be a special stupid tax for employers who hire stupid people!

    Werner held $500 in a bond, deducted $10 week till it reached that amount. The purpose was for future expenses that might occur after driver left, like missing Bol, tractor recovery costs if abandoned, or renewing a cab from odors,glueing Velcro all over the interior,pet damage, missing equipment like straps,tool kits,fire extinguishers etc. if after two yrs you were still there and had demonstrated responsibility , they refunded the bond. This was explained during orientation...

    Thanks, I had forgotten about the "No lazy SOB left behind" program, where they put people to work who weren’t actually looking for jobs. I guess having a pulse is just an option these days. These employers will never meet a good driver!
