Sorry. The thread did take quite the turn.

 

The same way they can fire you for alcohol in your system if randomly tested when you show up for work. Alcohol is legal.

Last time I check just because a substance is legal in a particular state doesn't mean the Federal Regs recognize that. In addition, and individual company is free to set there own thresholds as to what they will not allow as well.

 

They don't have the technology to tell if you are under the influence of marijuana. And what about CBD? It has no THC in it at all.

And yeah, the Federal part, that answered it for me.

But if it was Federally legal, I have my doubts that a company could still 'set there own threshold'.

 

Lots of companies are going to the hair testing because it goes back further, lots of pothead will stop smoking just long enough to pass the urine test, then once they pass and obtain their CDL, their right back to smoking again, Personally! I think ALL companies should use hair, I know one company that if you shave yourself bald, they will get it from your private parts, if nothing there? then they will send you home

 

Even if pot was Federally legal, the company can still not allow it, Just like allot of companies forbid firearms in their truck, even though there is no federal law against it
