Turns out this outfit hasn't registered its trailers in over two years! Can I sue?

    Alright, first the title is old. I'm just keeping the thread going 1.) to vent and 2.) to document what's going on.

    Second, it's hard to have a "clean" licence when you get a ticket. Might not be a factor, maybe it is.

    Find out in a week or so.

    Infosaur, I still think it's your responsibility to 1) check the legal details of anything you sign off on, and 2) accept your lesson and move on. 3) NEVER run illegal, especially, visible illegal. Like Spyder said, it might take 3 minutes to get another seat. Consider this - if you sue one company, how many other companies will want you around? You should have checked the registration and everything else on that trailer, and if you found it to be defective, sorry, won't do it. So really you want to sue them for your own mistake. Sue yourself, in that case.

    Update: the company issued new plates.

    They may cover the ticket but that's not final.

    what is "not final" to you..???

    you want them to hire a lackey to go and inspect things that you a driver is responsible to inspect..????

    it stills falls on you to fully inspect the entire rig, which by the way, DOES INCLUDE all paper work..


    good luck in your "not final" outcome, which if you want more than them paying the fine, best to be prepared to pack your bags

    "Not final" means not final.

    We were told in the meeting that drivers were responsible for tickets if we didn't pretrip. He then went on to say, "if we know about a problem and tell you to go anyway, we'll pay the ticket"

    Which is when a bunch of drivers pointed out that's not legal (telling an employee to knowing do something illegal). Actually I've been sick for days with some stomach bug and considering how much trouble I was in with the company I really didn't feel up to a shouting match. I was really glad some of the other drivers brought up the points I was going to make.

    Also management had no idea it was a $2500 ticket. I think they thought I was bellyaching about a few hundred dollars. When they realized I didn't want to be liable for $5k in two consecutive nights they began to soften their stance against me.

    So inspite of clearly stating at the meeting that tickets for not pre-tripping were on us, the owner took the ticket from me and said "he'd look into challenging it."

    So as of my last post (rolleyes) I don't know if the company is going to pay it, split it, come up with some sort of payroll deduction for it, or dump it back on me.

    So, like I said, "we'll see"

    One thing's for sure, if you ask an apparently dumb question like "can I sue?" if you didn't do your pre-trip, no matter how many times you recant in the thread people on TTR here will jump on you mercilessly.

    So thanks for that.

    But incase I'm not clear:

    GET OVER THE LAWSUIT PART OF THE POST!!! We're past that point and I'm just updating until this matter is resolved so I can shut this lousy thread down.

    (4 years from now some CRE driver might need it)

    It's deserved. I (explitived) up.

    But I'm somewhat disappointed in some of the guys who I've talked with on other subjects dogpiling on me.

    Maybe they're only reading the top post? Idunno.

    I guess part of my penance is to sit here and take it. (Maybe I'll remember this public drubbing next time I pre-trip?)

    Info, go to court on the tickets. Get another seat, before or after. I'd get my last check, pack my stuff, never look back...move on older and more informed. That's me, of course. When I was a young man, my favorite work phrase: "Fxxxx you, pay me off." Still love it, but have learned, finally, to not put myself in situations where my favorite work phrase is applicable. Best to you Info. Get a better company, be a good driver, settle down and earn a good living. J
