§ 396.9: Inspection of motor vehicles and intermodal equipment in operation.

(a) Personnel authorized to perform inspections. Every special agent of the FMCSA (as defined in appendix B to this subchapter) is authorized to enter upon and perform inspections of a motor carrier's vehicles in operation and intermodal equipment in operation.​

Note that is says "vehicles in operation". A vehicle legally parked while the driver is off duty is not in operation.

 

They'll probably then cite you for staying a minute past the 8 hour limit in the parking spot.

In the other hand, a vehicle and equipment parked are in operation, how did it get there ? I don't see the words 'in motion' or anything else that implies a rule one way or the other. hmm

 

I would like to tow a vehicle with no engine, to the rest area then when the DOT cites me for being there over 8 hours, tell him someone stole the engine while I was in the restroom. Would they believe it?

 

They came into a small truck stop a few years ago and were inspecting trucks. He came up to me and asked which truck was mine and he needed to see my log book. I stood in front of him and said I was off duty. He stood there for about 5 seconds then walked away saying nothing.

I went inside and told the owner. He came out and kicked them out. I love to hear Indian people when they get pizzed.

 

I got inspected twice in Ohio. What they do,they're parked 3-4 miles from rest area,and then they pick a truck and escort it to rest area. They did level 2 both times.
