Father passed away what to do with his truck? PLEASE HELP

    YES I READ THAT

    there is still a binding lease. one missed payment, and they can seize it legally. what are the possibilities they "say" no payment was received..??? what if there is another lien or attachment to the truck they are not telling him.??

    what if the dad got a small loan from yet another bank or credit union to make the repairs, and they have a lien on it.???

    again, a lawyer can be a better advisor than a bunch of truckers that think they know..

    not too many people think about , "final expenses'..

    we here have started to do so. i took my elderly folks to the funeral home, to make preps when they die. they want a cremation. they are putting some money down, each month, till the costs are covered. all other things have been taken care of by our lawyer a few years ago.

    in about another month or 2, i too will be visiting the funeral home, to set up my account. in fact, the paper work was already started when i took mom and dad that day for them, i just have to give a down payment, but even if i die before that, at the very least, the plans have been set up, to reduce the stress later on.

    not something every one thinks of, when they are fine and healthy. and yes, the survivors MUST deal with a whole lot of crap, and stress when someone dies.

    not trying to out match anyone, just trying to say as a group, we really do not know all there is to know about the lease and liens, and such of the deceased. a lawyer as mentioned by Semi, will be costly, but it will be better to pay him/her for the legal aspects now, then to be hung by the short hairs of an unknown, then seek legal counsel when it is way too late.

    Sorry for your loss and the bad spot it put you in.

    Be careful basing the value of something on what you see on the internet. Alot of them trucks may list for say 23k but in all reality they probably sell for much less.

    First off very sorry to hear about your dad.

    Now to give you a reference point about your truck and an option with the disclaimer that your situation may not be the same and if you decide to pay off the truck.

    I just very recently sold my 07 Freightliner Century with 1.1 million on it through Richie Bros auction. They are all over the country, very reputable and pop right up on google search.

    My truck sold for 19K which I got 16.5K -after their commission. They pay within 21 days after the auction.

    The process was easy and painless which was perfect for my situation. Just an option to look at.

    Im thinking that 2003 is a "true" Pre emission's truck. 2004-2007 had a pesky egr ??

    Sorry for your loss.

    Putting a driver on the truck would be a disaster waiting to happen. If it were my call, I would pay off the remainder of the lease. With the amount of money your father had invested in it recently, the only one benefiting from it will be the company he was leasing it from. At least if you pay the $10k to get the title and flip it for say $15k on the low side, you've at least recouped most of your expenses. At the end of the day, its your call. This is just my $0.02

    Like Northern Mechanic said its your call. Your dad has passed and you owe no one nothing. Don't let no one tell you different. Been there done that.
