need some info please

    i do have cdl, my current position doesn't require it so im not in a random testing pool as of now,
    i meet a guy that owns couple trucks, he runs one and hires out for the other, also has another guy that floats between the two trucks, one driver is 300 miles away and has abandoned the truck, his other guy is leaving out tomorrow (sunday am). he wants me to ride with other guy and bring back the other truck, i thought he'd have to dot test me first, i dont know and not sure if he cares at this point. i am legal to drive (current medical) but am i really, im not hiring on with him just doing him favor and making some extra money doing it. any thought, suggestions, i figured he would know but not sure if he doesn't or don't care.

    Just my opinion but, that's not enough info to make an informed decision about. There are no favors in our profession. We all must maintain professional licenses, pass drug test and be ready to stand up to an DOT level inspection any time we are behind the wheel of a Commercial Vehicle. To many what ifs, and things that could go wrong. I'd pass, or make him hire me on correctly, and then send me with a method of payment to correct any issues with the equipment when I got there, before I put it on the road. Just my 2 cents.

    No he doe's not need to DOT you, you have a CDL and MED card, your good to go, Companies do not need to have their prospective drives do a new Med certification, but they have the right to have it done, which is the case most time's

    The guy is really putting himself in a vulnerable position by not following the proper protocol as outlined by the FMCSA. You can't (legally) just put a driver on one of your trucks without meeting the minimum hiring requirements, including a drug screen. Whether he or you view it as just a "favor" or not.

    I didn't do it for number of reasons, but it's understandable what proper way of doing it is according to fmcsa. So if I want to be able to use my cdl without a job that requires it I have to pay to be part of consortium so I fall under the rules even though Im not an employee or an employer?

    There's a lot guys that operate their businesses in the grey areas. Most notably the use of employees as independent contractors. The IRS has pretty clear guidelines on what is and what isn't.

    The FMCSA has pretty clear guidelines as well on the responsibilities of the trucking company employer/employee as it relates to hiring a driver and putting them behind the wheel of one of their trucks.

    I know this because I'm just finishing up the process of obtaining my authority and it is a pretty detailed process.

    A simple cursory search on Google will supply all the information one needs to substantiate this.

    I'm not his employee and I'm not an employer, if something like this comes along again It would be be nice to make some extra cash.I have Google it, no clear cut answer found except for putting myself in a pool. But If my name is called my current employer doesn't have to let me go to testing site, even if it is only for short period of time. So possibly lose my job / get an arsh chewing or get a refusal. Wow.

    How would you be compensated? You mean someone would just hand you some cash after you perform your duties? Who pays the taxes on it? What happens if you get hurt? What happens if you hurt someone else in his truck?

    The point is to be legal in the truck. Or any other truck. How I get compensated or who pays taxes isn't the issue. Again point is to be legall, incase something did happen. Otherwise I never would have asked.
