legally the way to do it is once you flag you are at shipper or reciever and showing getting loaded or unloaded by law you are supposed to show yourself on line four, on duty not driving. yes it eats up your fourteen but this is the way it is supposed to be done. the only upside is to call dispatch and get pay while waiting. if you do it any other way and something happens then it will come back to haunt you.

What part of NJ are you running out of? Is there a reason why you have to take the CBE? have you tried running I84 to I87 into NJ . I've run Paramus to Lowell Ma in around 4 hrs going that way

yes you get a lunch break and according to dot you can have up to 2 hours during your work period showing this as most companies allow. but sleeping is in the sleeper birth. anytime you are in the drivers seat and not driving is shown as on duty not driving. taking a crap is off duty but it depends on how much time you do it also. you can not show two hours taking a crap. that will red flag for the dot and if it takes only fifteen minutes or less then it is better to show it as on duty not driving since when you are relieved from the truck for a break you still have to show a safety check on the log book.

I maybe wrong, but even going off duty for lunch or whatever the 14 hour clock keeps ticking. His only chance to keep legal is to avoid the CBE traffic delay or layover

when I originally posted I didnt realize you were in a day cab. dont log sleeper time! sorry. as for the fourteen hour rule, this is different for different states. In florida there used to be a 300 mile limit that they went by instead of driving your 11 hours. however, this instate driving(day driving) differs from state to state and is not federal. instate drivers only have to be 18 years old interstate have to be 21

you are right. the fourteen ticks no matter what you do during the day unless you take a eight or ten hour break then you can keep going but then you get into the split stuff and that will screw up most drivers.

what ever you do check your local driving laws for logging. fill out your logbook accordingly. as far as traffic goes, not many otr drivers log it, they log miles and estimate and average speed limit for the roads they traveled and log it. 300miles across Iowa is 5hours. this is also how dot determine what you travel. they dont watch tv for traffic jams that happen 100 miles away.

Wow there are a lot of reply's. I want to say thanks and I'M reading them all.

OK, let me add that I'M an hourly driver and get paid on a time card, that's from when I punch in to when I punch out.

I read in a DOT hand book that I can log off duty when the trailer is being unloaded/loaded as long as I don't have to be around while there unloading/loading the trailer, and that's how my situation is. However since I do punch a time card can I still log off duty when I'M getting paid for it???
