Also you said other drivers were hired in to work docks but they werent thrown in the pool, how do you know they werent included? Did a supervisior tell you? If he did he would be violating privacy. If other drivers told you dont take them at their word. Was there some kind of accident or something that may have precipitated the random?

Their only argument was that I have a CDL. So that's why I was put in the pool and not the others. When anyone is interviewed for this position, they ask if they would be interested in enrolling in the driving school when it starts. Those few who said yes were not thrown in the pool. I know this because there are drivers theres who've gone through the program and have been for the dock for YEARS and were not put in the pool into They became drivers. Nothing could have given them suspicion, I'm highly praised on the dock as one of the top performers so it wasn't my performance. On time everyday.....idk

Dont know then. Best I can tell you is lay off pot. Not being judgemental. U read the posts about my cousins in the begining. I personally just hate drugs. Beat advice is to contact a real lawyer. There are a lot of wannabe lawyers on here. Just consult a real lawyer and see what they say. Good luck.

I have tried to find the regulation that covers the driver pool but don't really have a lot of time to research it. I believe your company has misunderstood the driver pool rule. If you are NOT driving a CMV on public roads you ARE NOT required to be put into the driver pool. However your company can legally put you in the pool. It still comes down to the fact smoking bong and trucking don't mix. I'm not going to sugar coat it. For the record I think you should be able to smoke in your private time as long as your smoking does not affect your working time. Much like alcohol.

I just went to look it up! It Cleary states that I wasn't supposed to be in the pool. i even called the person who is over all dot drug testing for the US. And on his answering machine, is states that ONLY THOSE WHO OPERATE CMVs IN THE PUBLIC are subject for random testing.

I wish you lots of luck.I don't get it,why even smoke weed when you have a CDL and you know good and well its illegal in the trucking industry.This is going to be tough to beat because you tested positive.The employer can argue saying that you looked and acted like you was high while working and so we gave him a random for our peace of mind and for that reason they have every right to test you and no jury will dispute that.TB John Thanks this.

So what you are saying is if someone comes to work after doing crank and say they're working on the dock and the boss notices that employee acting different he or she is not subject to a random just cdl holders that's driving trk are only subject to randoms but the entire other workforce is exempt from it?is that what youre saying?Can you tell me where you found your info so I can look it up and better understand this law?TB John Thanks this.

You are going to find out, that the court system is not eager to help those, who approach with "dirty hands", so to speak. Were you supposed to be tested? Maybe, maybe not. But you were doing something, that's still illegal in most of the 50 states.
