because they had lease op's that were being said to be independent contractors and the way it was being run they were just company drivers paying fuel ins and everything but had no control over their truck own home time what they hauled and etc because by federal law there is a real fine line between employee and independent contractor

 

you are an independent contractor, you're basically running a Regis office and buying a franchise

You can't buy a McDonalds Franchise and then do your own thing with it, that's not how it works

there is no forced-dispatch with owner/ops,


so this lawsuit just sounds like a bunch of whiny drivers whining about something.

 

They are still referred to as Central Refrigerated by many of their customers as I found out doing deliveries and pick ups. They are Central Refrigerated still. Swift has their own refer trailers.

 

I am the class leader of the lawsuit, and it is very real. Remember that these large carriers use every advantage to increase their bottom line. Every single one of them. If you want to lease operate, buy a truck under your company name, then lease it to a carrier, and maintain absolute control over your truck. A true owner operator!

 

As the class leader of the lawsuit, Under the law, the "independent contractors" were actually employees. Which means employees were paying taxes and fuel for the company, relieving the company of the expenses and of the truck payment.

not buying that, a 1099 isn't an employee,. plus an Independent contractor (Even though you guys aren't "independent") says "contractor" right there in the job title.

you're renting company equipment thats why you have to pay for everything.
