It shouldn't be. Everything I read says that if the trailer weight is over 10000 lbs or the combination of the truck and trailer weight is over 26000 lbs, it is a commercial vehicle. You did not hit either of those numbers, so I am stumpedTom Instan Thanks this.

They shouldn't, other than getting the cops attention. But I just found something else, did you cross any state lines? According to fmcsa any vehicle involved in interstate commerce and weighing over 10000 lbs is a commercial vehicle. So you would need dot numbers, a log book, and a medical card.Tom Instan Thanks this. -
I just found it, your screwed. In PA a vehicle with a combination weight over 17000 lbs is considered an intrastate commercial vehicle. It must have dot numbers, you need a logbook, and dot medical card. It's all going to come down on you, since you were the operator

So how do the two citations (no health card and no duty log) affect me as someone with a class C license and no CDL? Assuming I have no plans to drive a commercial vehicle again.Last edited: Mar 1, 2016

They probibly come with fairly big fines, but I'm not sure, I would call the state and maybe a traffic lawyerTom Instan Thanks this.

The key term here is GVWR.. not necessarily the actual weight of the vehicles. The officer just has to look at the information plate on the trailer and can see if a CDL and all the trappings come into play

I would say (my opinion) would be that you got caught and cited for driving a CMV that required licensing, registration etc that you did not have. It will probably be a pretty large fine and probably points, but its too late to fix it, you'll just have to take your medicine. The boss or whoever set this whole thing up should come across for any fines and whatever if they are honorable.ajohnson Thanks this.
