Here's the original thread I posted a little over a month ago. http://www.thetruckersreport.com/tr...-on-a-34-hour-reset-criminal-mischeif.305415/

Quick summary for the uninitiated or those who don't want to comb through 24 pages from the previous post...

I'm a fairly new driver, at the time of this incident I only had a little under 3 months of driving experience after completing training.

On a 34 hour reset near Daytona Florida, Co-Driver and I went out to some bars where I drank excessively to the point of blacking out - I had never blacked out before in my adult life, really not a big drinker at all. I was hitting on a lady bartender and just overdid it, really overdid it.

I don't remember a thing, even now - which is either a blessing or a curse, I'm not sure. But from what I've gathered, from my co-driver and the affidavit/witness statements - I left the bar and returned to the truck stop my truck was parked at where I demanded a scale ticket. When they could not give me a scale ticket for I had not weighed, I got upset with the attendant knocking some stuff from the desk, then went outside and knocked over a concrete trashcan. The police arrived shortly thereafter and arrested me for Criminal Mischief.

I couldn't tell you why I would do something so stupid, I wish I could justify it - but I can't. I had zero intention of even returning to the truck stop that evening. My plan was to get a hotel room; I was worried about getting a DUI sleeping in my truck.

My co-driver, a new guy like myself, not knowing what to do once I had been arrested immediately called dispatch and notified them of the situation. When I got out of county and returned to the truck I had a message telling me to contact them - which I promptly did. They connected me to their safety department who asked me what happened - I told them the unadulterated truth. I was unaware that drinking on a 34 hour reset was against company policy and by admitting such required them to immediately terminate my employment.

I don't blame anyone other than myself for this outcome - it was my choice to drink, my ignorance of company policy, my own actions - that has put me in the situation I am now in.

Since I last wrote on here, I was able to hire an extremely expensive attorney (perhaps not that expensive but I thought $2500 was quite a bit excessive) - who was able to get my case dismissed contingent on me replacing the concrete trashcan. It took about a month to play out, but I received the best possible outcome considering the situation.

Now I'm on the job hunt and quickly learning just how negatively this has affected my ability to find a job - which brings me here.

Since I was terminated, the cost of my CDL training has fallen on me - in attempts to find another company who would hire me and take that school debt on I contacted the company who set my first employment up. They set me up for "secondary placement", where they circulate my application to several companies in attempts to find me another job. That was Monday.

Since then, I've also made an account on indeed.com , and attempted to get my old job back. My old company refused to hire me back, and I've had no other calls. I'm beginning to think my trucking career is over before it even really started and I'm looking for advice; if anyone knows of any companies that would potentially hire me considering the above stated facts; Less than 3 months OTR experience, clean driving record, technically clean criminal history, no tickets, free of drugs.

Really I'm just worried this is it, that I won't be able to find another job. Maybe I deserve it, but I'd be lying if I didn't say I hope that's not the case. I was good at my job and it seems awful that 1 terrible mistake like this could ruin me forever. I would have never drank in the first place had I known it was against company policy - and you can bet your bottom dollar it'll never happen again.

Anyway, sorry for this wall of text. If y'all got any tips/suggestions for me I'd surely appreciate it.

Have NO answers to any of your questions, and I apologize for that. . . Just wondering, is there any way the bartender ("tar-bender") may have given you an "aspirin" for your future headache? My wife grew up in Florida in the 80's / 90's and tended bar, and that kind of activity was rampant. That's why she quit and married me and got her CDL.
    Just a wonderment.
As far as the other stuff, GOOGLE it, and do searches on here. I've seen a ton of stuff within that realm of subject; just sitting at a dock and can't do the search for ya. It's a miracle I can type but I feel for ya, man. I like my occasional weekend "beer" but . . . I'm home weekends. Wish I had the answers, just wondering if you might have gotten "spiked" by the 'hottie that wanted your body!'
Good luck, man; keep us posted.
Ps: never "imbibe" while the truck is in your possession is how I was raised, but then again, I'm old. (Under a load, or not. Unless you are an O/O.)

I literally spit water all over my computer screen after reading the line about the scale ticket. This is truly one of those "better you than me" situations. My opinion: you're an idiot when you're drunk (like most people) but unless you're drunk behind the wheel I don't personally see how that makes you a bad driver.

In all seriousness, there is no reason for you to disclose this "incident" to any potential employers. Since your lawyer was able to get the case dismissed you don't have a record. Most states have laws now where your previous employer is only allowed to verify the amount of time you were employed and whether or not you're eligible for rehire (pretty sure that's a no in your case). Bottom line: unless you volunteer the information they won't know it happened. You probably want to come up with something plausible in case you're asked why you left the old company and can't go back though...

Tons of companies don't give a crap about your schooling, as long as you have your cdl you're golden. (Pride is a decent outfit).

As long as they didn't smear your dac you should easily be able to find a job this week

Get on craigslist for your local area. Find the shadyest 1099 operation on there ... go pay your stupid tax by working for them for the next year or so, then look into a "real" company.

I'm just happy to hear someone take responsibility for their actions.
With that being said, it's not over. Like in other posts I wouldn't say a word.
I have been in trouble with the law a few times and every time I was drinking, so I stay away from it now (that I'm a little older and wiser)
    You'll be alright.

Stay away from 1099's and the megas. Look for a smaller company and pay the schooling out of your pocket.
