breath test problems

    ok from my experience the ones we used on the road only gave us probable cause to transport to a dept with a certified and calibrated breathalyzer. That is the one that can be used because it is tested and calibrated and in SC it would have been recorded by a camera also. He needs the name of the officer at the dept and the dept name and contact info.

    His company already told him they figured his alcohol amount would have "worn off" by the time he got to the police station, but that was like 30 minutes :O
    and BTW: this was at about 8AM...so who on earth would be drinking at that hour, but a hard-core alcoholic, and of so, I'm SURE any alcoholic would have blown way over that!!

    states differ we had to clear the mouth and wait 20 min in SC while it was recorded.

    Trooper to trucker... so you mean the ones at the weight stations only show probable cause??

    and yes, I told hubby to go back to the police department, and get the NAMES of the officers who were with him...as they can stand up for him in court if need be.

    Ill buy that I just remebered the requirment of a wait time wasnt for sure on the exact amount. Been alot of years since I was young and dumb enough to worry about it.

    Your husband needs to talk to his company not you.He took the breath test not you,his company will want to talk to him.He got to leave after all this was done didn't he? If he was still detained then ya his company would have reasons to be concerned.Ask hubby if he drank anything with alcohol in it.An officer made me take a breath test before at a customer.The receiver called the cops on me because he said I smelled like alcohol.Come to find out it was my hair spray.It doesn't take much for an officer to think trk drivers are on drugs or drinking.

    the company has already sent someone to take over his load/trailer...while he has to drive home (back to Canada) with his empty truck. I guess maybe the company has to watch their P's and Q's in this situation...

    Yes papptyJ... the weight station and police did NOT detain him...he just has to wait for the company to take over his trailer...and they said they want to talk to him about it.

    Yes if administers correctly it give pc lawfully detain someone and transport them to a facility to administer the state certified test at the dept.

    Ok once you can't freely do what you want then you are detained.
