DAC report disputes

    I worked for Werner Enterprises from 11/2/15 to 3/12/16. During 275hr training, on 12/12/15 I backed into Werner trailer at their Las Vegas drop yard. I reported it, sent pics to safety. I was given 40 extra hrs and 45 days probation. Non DOT accident. On 3/10/16 my trailer clipped safety pole & bent outer tandem rim. Repair truck sent out to fix. I reported it, sent pics to safety. Non DOT accident. Later this day, sharp right turn, my front of trailer hits iron gate door & knocks off hinges. I reported it, sent pics to safety. Non DOT accident. Werner placed all these incidents on my DAC. I called HireRight and put in dispute over the 12/12/15 incident & Werner's decision in terminating me. If my dispute claim fails, what other ways can I fight to clean up my DAC? Any advice, help, insights are appreciated

    There are law firms that specialize in this area..... Probably find a few on the OOIDA website.

    Just because an accident is listed as a none DOT by a company does not in anyway mean it did not happen. Also if I read correctly that last accident is why they fired you. I doubt very seriously you will get any of this negative information removed. Outside of that I don't have any advice for you.

    You just freely admitted that you hit the stuff and tore up their equipment. I don't understand what it is that you are disputing?

    If you don't want a past employer telling people that you hit stuff and tear up equipment, then don't hit stuff and tear up equipment.

    I doubt you would be able to get any of those incidents removed from your DAC report. While you are right, none of them were DOT reportable, they were all preventable. Companies use DAC for just those reasons, to find out stuff about our driving ability. All of these events did cost the company money to repair the equipment. While you may not be an unsafe driver, you certainly had some unsafe events. If there were events that did not happen that were on your DAC then you would have a reason to pursue an appeal of your report. You've said that these things have happened, so you do have to live with the consequences.

    The whole purpose of DAC is to track incidences that are non-DOT reportable.

    From your post it seems everything they reported is true so I don’t think you have much hope of having them removed.

    Several weeks ago I was in the Yorktown Virginia IHOP having breakfast with some friends and we struck up a conversation with a couple at the next table. This guy had just been fired by USA Truck and was asking me questions about DAC. I finally got him to admit that over an 18 month period he had had 5 preventable accidents the last one was hitting another tractor at one of their terminals and he was fired. One of the hardest things for me to say in these situations is to suggest someone find another job because they are not cut out to be a trucker. This is my suggestion for the OP.

    after 7 years, all that a DAC report is supposed to say is, that they cannot say anything after 7 years.

    you had accidents while in a company truck. they will be on your personnel file as well.

    these will stay with you for at least the 7 year period. you have NO recourse.

    5 months and 3 accidents with property damage, I'd worry about THAT! Not your DAC. This is easy, your NOT going to get a job with any company that uses DAC, plain and simple. So start thinking about smaller companies that aren't going to use it. But more importantly WHY are you hitting things? That's not normal dude. Maybe a refresher course or something but whatever you do, don't just keep driving. You have a pattern going and I highly doubt it will change without effort on your end.
