If that's the case, then why do companies fret over driver past accident and ticket history? Why not hire any idiot, speed freak?
Hiring standards DO matter. Instilled [or allowed] culture in the driver force DOES affect fleet performance, for better and for worse. I just don't see how FMCSA (DOT) can discount all crashes where driver actions/inactions were to 100% blame, and hold the carrier harmless.

In this case how could the carrier have prevented this? They can't. If the driver has no record of anything there's no way of knowing he's a closet drinker maybe or it was a one time thing.
And companies do fret over a drivers past history. Chances are he had no previous history. Especially FedEx. I know the carrier here in NH that does all the ground freight for FedEx. DDA services. They do the U.S. mail run also. They do an extensive search on any driver before allowing the contractor to hire them. That's all they can do!!!
So, with that being said, how could this have been prevented pray tell? -
Fed-ex is just as bad as swift where I live, and is not to far from where this even happens

one hopes they fry him, what happened to innocent until proven guilty.
The officer lived, so it may have been a slow speed incident, and for all we know he could have been idling by as far over as he could go and the officer stepped out in front of him.

FedEx gets a bad reputation mostly because of Ground...hence the nickname "FedWrex". Whether FedEx is liable for accidents caused by someone who works for a contractor all depends on whether they are classified as an "employee" or "independent contractor". FedEx has already lost many lawsuits from Ground employee's who argued that FedEx had A LOT of control of how Ground was to be operated, negating what it means to be a TRUE independent contractor. Ground employee's were even required to wear FedEx uniforms, but didn't get the pay, OT, benefits and retirement that Freight or Express got, since they are actual FedEx employee's.
There's a lot of companies that contract work out so they can get away with not having to pay OT, benefits and retirement AND not be liable for any accidents that may occur. Uber and Lyft gets away with it. Flowers Foods gets away with it too with their bread truck contractors. Amazon DEFINITELY gets away with it...especially since they've expanded they're final mile delivery service to one day and are contracting ANYBODY with a pulse to make sure they can deliver their packages on time.
US Postal Service also contracts work out too...similar to the way FedEx does. But unlike FedEx, contractors working for USPS has to abide by DOL Mcnamara O' Hara Service Contract Act and employee's work for whoever the contractor is...whether it's Hoovestol, Matheson, MCA, B&B, MTI, Eagle Express Line, Pat Salmon, etc., and the contractors are responsible for any accidents that may occur. No different from JB Hunt or Swift doing Wal-Mart or Costco loads, or Black Horse Carriers doing Aldi, JED Trucking doing ShopRite, A Duie Pyle doing Wegmans, Grocery Haulers or NFI or Transervice doing Bimbo Bakeries. -

Unknown if he was drinking. DUI could be pot or harder, or alcohol, or all of the above.

How in the hell you can't move over AT 3AM, what traffic in Cali become so bad that you can't drive peaceful even at night ???

I dont see how a DUI operator can be justified as "These crashes are so preventable". A DUI is no longer rational and was the primary culprit for the accident caused by operator negligence. It isnt FedEx fault that the operator was a drunk. It is however a problem if FedEx has terrible working conditions it causes their drivers to seek an escape either by drugs or alcohol.
