Do truck drivers have to pay for being towed?

    I found just a letter from a lawyer that plan on sueing them open companies mouths. I get them done for around $100.

    Exactly. Right now, theres no proof of an issue. All they have is a pay statement that deducted $1,000 from his last check. By sending a Certified Letter-Delivery Confirmation Requested, stating the issue clearly establishes the issue once he receives it. Then they have proof there is an issue, combined with the pay statement where they admitted taking the money out of his check. An employer cannot take Any money out of an employees check unless they have Written Authorization to do so.

    No no no....You go to the court house in town. You talk to the clerk of courts. He/she will agree it was wrong. The clerk puts you on the schedule. You pay around $35 for the clerk to get the Sheriff to serve him the court appearance. If he doesn't show up the court issues a bench warrant so next time he's stopped for a traffic violation he could be arrested.

    If he shows up the clerk of courts explains to him he has to pay and no need to go into the court room. Either he agrees or goes in front of a judge. Either way he signs an agreement to pay by a certain date. If he doesn't the court goes after him, arrests him and jailed for contempt of court or he agrees to go and pay you that day.

    Been through this. It's easy.

    I think a bill for towing during a winter storm is not so much "he said/she said" kind of thing.

    I agree, board of labor will help in this.

    No, not missing it yet. Instead of physically tired from flatbed work I'm mentally tired when I get home. Just enough energy to cook and go to bed. Still have the truck and trailer. Going to register it as a plain old car/truck and drive it around once in a while and pick up hot chicks. They love truck drivers!

    Totally... Do NOT mark it up to education!!!

    Start with a letter telling him you will be contacting the Board of Labor about this issue so they can help getting it addressed. They can blow off your brother but doing so to a State request is a bit more problematic for him.

    Small Claims Court, as mentioned above, may not be the best option, but it can work as described above... Only down side is having to prove the case and risking losing then you are stuck. Going through the Labor Board might be just the initial letter saying you will be contacting them or the next step of them contacting him.

    It might vary from state to state but highly unlikely they can withhold pay in such cases.

    OR...

    If they are now contacting him to come back to work for them, giving him the upper hand, then he should remind them that he still has an unresolved issue outstanding. And that if they are serious then they first need to address that $1,000 as a show of good faith ... Then if they make it right and issue him the balance of pay due, never answer their calls again.
