BEWARE of these guys

    I did everything that was supposed to be done. But that doesn't stop a company from saying a negative rating. Maybe it's stupid but it's how I think. As a new business owner and with a ton of money invested in my company I am sometimes over cautious and always think of the worst case scenario. I learned my lesson and as I previously said I cant blame the broker since it was a COD I am just upset that they didn't try to pursue making things right with me.

    I guess you don't realize, the broker is responsible for payment if the customer fails to pay.

    That's not what the contract says it says broker is not responsible for payments to carrier so I am assuming that means I am on my own

    To write a bad check in ny is not just a civil problem it is a crime in the nys penal law.
    And I think it is a fellony to write a check on a closed account.
    What I do in ny when this happens is go to the bank the check is written on and have it posted. This is offical documentation from the bank that the account has non sufficient funds or is a closed account.
    Once you have that you go to whoever the local police dept. is and give them the documentation.
    The police will then go and arrest the check writer.
    It always amazes me how fast the want to make good when they have hand cuffs on.

    There you go. Get that documentation then give them a call and tell them they have 24 hours to pay you what you're owed plus $100 for your time or have a warrant out for him, his choice

    lulld, do you know if that law applies in other states? We rarely run NY but it will be awesome to have this trick up our sleves.
    ryan, you can dispute your negative rating and central wont be able to leave it posted if it's done in retaliation. give them the rating

    I am not sure in other states.
    I am in ny and have a transmission and general repair shop along with my transport bussness.
    I have had this bad check/ closed account thing play out many times overe the years and I have 100% recovery rate for what was owed to me.

    You also have the right in ny to charge fees that are up to double the amount of the bad check.
    Come to think about it new york's bad check laws are about
    the only good thing about running a bussness here LOL.

    Sorry you can blame NO one but yourself. You said it was COD and you took check hard to understand why there are no excuses for this other then the person in the mirror. Its a felony to write a bad check take it to the police and file. Why are you letting them walk all over you stand up take charge.

    I would not let this go by without filing charges. Whether you are a new business or well established, you cannot afford to let this slide. I would suggest you pursue this ASAP since you may be dealing with a legal time limit on filing charges. When someone writes a check on a closed account, it becomes criminal. You may still be able to file a claim on the brokers bond, even though the contract says otherwise. From your post, it sounds like their might have been some collusion between the broker and shipper or consignee.
