I worked for a carrier as a company driver in 2013, I decided to quit the job and pursue other interests. I have had two other jobs as a company driver (please keep the job hopping comments to yourself) and I haven't ever had an issue with previous employer DAC entries until now. I go take a drug screen and renewal physical, get finished and a few hours later receive a call that I am not eligible to operate a CMV due to a refusal on a drug screen from 2013.
I was completely thrown for a loop and didn't know how to even muster a coherent response. The company I worked for in 2013 is now owned by another company that is when the trouble started. The other employers checked the DAC and obviously nothing was there because I was hired. I have been in chicken coops, renewed my license and medical card and no one has ever mentioned me not being eligible. What can I do about this?

They are still operating under the same name, just different ownership. They said according to their records that is what happened. I didn't refuse to take anything other than their freight. I didn't refuse a load, that was just to demonstrate that I did nothing wrong other than quit without notice, which is bad enough on its own.

It doesn't work like that.. now had the O/P been notified of the test and left during the test OR failed to show up to the place specified for the test.. he's not got a leg to stand on.

There is only one thing you can do, hire a lawyer. If you know your innocent then fight. It sucks but if you win you can probably get them to cover the legal bills. This is your livelihood, fight!
I'm a fairly mild mannered guy but if anyone tries to take away my CDL or my ability to drive I'm going to fight dirty.
