Detention vs overnight

    Hello i need advice.
    I sign a rate con that said that the broker would not pay for detention. And i was aware however when i got there the product was not yet ready and the shipper told me i would have to wait till tomorrow. So i call the broker and explain it to him. Also ask for overnight pay but he said they dont pay for that either but looking at the rate con it only talks about detention there is nothing about overnight pay. I DH 200 miles and basically lost the day. Can i fight or is detention the same as overnight? And if i could fight it. Is there someone that can help me with the process. I know i would get very little money but im would do it so brokers like this dont get away with things like this. They are called TRACER LOGISTICS LLC. out of goodlettsville TN

    If the rate con says pick-up is on 6/7, then they just broke the contract. Use it to get a few more hundred dollars on the load. If they don't want to move, tell them you have another shipper with a load that's ready, you have to go. Be ready to eat more deadhead, if there aren't more loads in that area.

    Do you know of someone that can help me maybe a small claims court or something? When i spoke to him he said they dont pay and he stood very firm on his decision. However he did brake the contract since this was overnight pay not detention. I told him at the end that i would just look for another load and he said that was fine with him

    The only leverage you had to make more was if they were going to be left with a load they couldn't move. I think you're going to have to cut your losses on that one. There isn't anything in a rate con to penalize them for breaking it.

    Thats what i leverage with him told him if he wanted me to wait for the load till tomorrow i would need overnight pay. He call me back 5 minutes later and very firmly said we will not pay any extra on this load. So i guess i will just let this go. They are just a bad broker to do business with.

    whatever load board you took this load from, at least report them as bad brokers, and explain your experience so others can avoid this. Thank You.

    Crap happens. The first thing I was taught when I came up, 'you have to take the good with the bad'. Best advice I was ever given.

    Yo once you got there and the load was not ready on the given day and he acted a fool about detention and lay over pay you should have asked for a truck ordered not used. You probably would only get 100 to 150 but it's something. If he didn't go for that I would file a claim against their bond. I bet you get some action once you file that claim.
