Once you stiffened your arm and then the muscle spasm it certainly would appear that you were resisting the officers attempt at detain you. First off you left the scene, that's still a hit and run. That being said if you are not convicted of a crime it doesn't matter. Many companies will still hire on with a misdemeanor, but its up to them.

Actually if it is not a lawful arrest he cannot be charged with resisting so that could also be challenged.

I have attained an attorney. Only charge was disorderly conduct. Virginia disorderly conduct law states that it has to be in public. I was on my front porch. First officer even admitted he couldn't do the resisting because I wasn't under arrest and he admitted to not telling me I was being detained.
Attorney requested body camera footage, guess what they erased, yep that cam footage they kept bragging to me about.scottied67 and NavigatorWife Thank this. -

Yea, unfortunately drop the coin on an attorney. Your at the mercy of the judge. And it's basically your word against theirs I guess.

Nah, when he noticed what the fool was fumbling with, he should've calmly presented his own so that when the thug turned his head as he raised up his own gun, all he'd see is:
...and of course if he didn't drop it, you'd drop him. Then you hold 'em there as you dial 911 to report the incident.
Of course, if you DIDN'T have the necessary tool to defend yourself, you were right to turn tail & run. Your mistake was not dialing 911 and reporting the incident ASAP...because usually the one who reports it is the one believed by the cops. By fleeing and assuming that was the end of it, THEY got to be the victim of a hit & run, leaving YOU fitted with the chrome bracelets.
And me personally? As a general rule of thumb, I don't turn my back on armed individuals...whether they have a badge or not...especially if they approached me while I'm on my own property. If they want ME to lay down my guns while talking to them on MY front porch, then they need to leave their own guns in their car when they come to my door to talk.TripleSix, spyder7723 and KriegHund Thank this. -
