Got pulled bobtail over on I55 in Illinois near BNSF ELWOOD (Railyard) @ 11:40PM and there was an inspection checkpoint. Lady trooper came upto me and said, hi.. random paper inspection.. so I do the usual thing and give her everything. She comes back and says.. well, your logbooks are good.. but there's something wrong also. I ask her, what? She says... your recap on the right side is not filled out the last 7 days and that is why your getting a log form and & manner violation.
WTF!? Here I was thinking, as she's walking back.. knowing i'm all good.. im about to get a clean inspection bonus for $300 from my company.. she hits me out of the blue with a log and form manner violation for no recap being filled out.
For 10 minutes, I am trying to convince her and explain to her that recap is not mandatory and I dont need to fill it out. Also, tried to explain to her that im not OTR nor does my job have me fill it out due to my hours. HELL.. I even said, some logbooks dont even come with RECAP! I told her that I have been stopped many times and went out clean, never using the recap. I used all aspects and points but it was no good. She was stern on giving me the violation and just pretty much tossed it into my lap and said have a good day.
Guys, am i mistaken here? is this a new rule? my safety guy said she's wrong and he's filing it with DATAQ.
OK... Am I misinformed or are they right?

DataQs allows you to request and track a review of Federal and State data issued by FMCSA that you feel may be incomplete or incorrect. The system automatically forwards your Request for Data Review (RDR) to the appropriate office for resolution and collects updates and responses for current Requests

Yup, i did it once, had the company pull my request for review and removal. Not my dot number, not my call... they didn't want to bring unwanted attention to the company.... worried about being targeted at scales yada yada...tinytim Thanks this.

You could have asked the lady trooper to call her supervisor and stopped the report in it's tracks. When your right, don't accept bogus reports.
