Yeah i think not getting involved is best. Call the cops call who ever take pictures but dont let the guy know. Dont put your self at risk. That trailer i hope its not loaded because its done. It might have a chance mt but if you get caught. Not worth it.

Right. But if it's open and you're there on the fuel pumps you have no expectation of privacy.
If you were in a bar (private property open to the public) and start acting a fool, and I whip out my phone because I think it's the funniest thing I saw all day and then post it on my Facebook for my friends to see, you can't do a thing about it or to me. You weren't in the bathroom (yet) and that's the law of the land. I have a right. But do people behave like they might be on YouTube before they get home? Nooooo!

I remember the pre trip. No more than 3 rivets missing in a 2 square foot area.

Also there's a part that says the side of the trailer is intact.

    Nope. Not legal.

And OP, I know you didn't take the video, but as far as life lessons go, don't take videos of truck drivers. Those guys are crazy. Who knows what might happen.

Depending upon the state you are in is what is legal and what is not. If you were in PA, it is legal to video tape anyone in public. It is illegal to have audio included. That breaks PA wire tap laws.

Also goes for phones. All parties in PA must know they are being recorded on the phone for it to be legal.

I wonder if that driver had an over height permit? That roof was pushed up at least 6".

Their is no "rub rail" on that trailer. This trailer has two rub rails.

This trailer has a broken frame:

Just because you see every mega-crap driver rub that rail with no concern against every yellow steel bumper post, does not make it a rub rail. I know some drivers call the lower rail a "rub rail" but those that do must have flunked pre-trip class. Rubbing or damage to that lower rail, or the upper rail like here, is damage to the frame.

The trailer is a monocoque structure: https://en.wikipedia.org/wiki/Monocoque.
Damage to the rails or significant damage to the skin will collapse even an empty trailer.

That thing should have not been on the road. That is far beyond OOS. Loaded or empty.

A blind man could have saw that one.

It should have been secured with some strapping and packaging before ever hitting the road, even on its way to the junk yard.

The guy had no business endangering anybody life with that thing. Obviously he had no clue and ran into something and was just toting the trailer around.

    Hm.

I so wanted to look under the floorboards but mr Mad and maddere might take offense. If the damage is clean across that thing will fail fast. If it is not and it's loaded it's a russian rolette. It will fail.

I think that I would not be that bold with camera in the face of mr thinking about madder. That kind of damage is not acceptable because if you see it up top it's compromised the box top and bottom.

It's a dry van, the side "rub rail" as you call it is integral to the structural integrity. There is no main frame rails.

**** right, even Swift, Western Express and
Carolina Cargo know when to put a trailer like that IMMEDIATELY OOS. The damage to the frame rail alone has compromised the structural integrity of the trailer.
