    Hmmm never heard of em but that don't mean they don't exist cause the eastern euros are starting to show up there too .
    And yes Nebraska is a right to work state .

    We think he got angry when I didn't respond to his calls earlier in the week. I was off call though. When you stay our 6 weeks at a time, you tend to shut off phone when you get home.

    He's not an eastern Euro, but gosh I know how you feel with those guys booking dollar freight and driving price down to record lows

    But, I was asking more specifically about federal protections. There's no way a company can take truck without notice. All the guy had to do was call me and say you're fired lol. I'd have cleaned truck out and looked for next job.

    There are no protections for the driver. You were employed by him, he terminated the employment. About the only thing you might get help with is the theft of your stuff. Even then you might have a bit of a problem getting the cops in Omaha (as that is who you would need to call) to do anything. Might wanna mention the theft to him and say if he ships it back you won't press charges, but that may just get him to toss it in the dumpster and say "What stuff? You emptied out the truck on your home time."

    So I guess I really don't have any good advice other than good luck getting your stuff back.

    I can understand your burnt out need a break. I don't have a side just an opinion as a guy who has had a few drivers and can see both sides.

    Next time you start at a paper log company legal or not isn't the issue. Only run as hard as you are prepared to run for the duration of your employment. If you start that way it's all they expect. If you start running 6k miles a week it's what tgey expect. I will be honest if you worked for me, had my truck and wouldn't answer your phone. I would come get my truck too. Obvious you quit. I realize he was calling to say hit the seat got a hot load. You need to tell him no. It's hard to plan ahead with no communication. Time off is between you and him not for me or anyone else to decide. You had your big boy panties on when you decided 6 weeks out was enough. When you decided not to answer your phone at least once a day. I say put em on and go to Omaha and get your stuff.

    The only thing I would suggest is something to do with retaliatory termination when you refused to break the law with the logbook.

    But then you have to basically admit you were in fact breaking the law...

    And I guess if you push him too hard on anything, he could "audit" you and report you for falsifying logs.

    Best bet is probably just to ask him nice if you can pay him to ship your stuff, and you agree to quit on "good terms".

    (and hope he doesn't read this! Lol
