You guys do know that in the broker-carrier agreement that every carrier must sign, it says that the carrier cannot solicit directly to the customer or he must pay X% (10-20) to the broker. You guys should read the agreement before signing...although not all brokers have agreements, most do, and most have that part in there.

True most if not all agreements do state the above. It is your job as a small business man/person to determine who is the customer and who is not. It also does not prohibit their "customer" from soliciting you for services. Just sayin.Joe Dan and whoopNride Thank this.

It's a worthless clause that does nothing but insult the carriers. We would never use it in our agreement.
We would also not do business with the type of person from a carrier who would undercut our shipper relationships and try to go direct to our customers. -
Truth be told. If a "customer" would so easily change their service provider. The "customer" most likely won't stay with any one company long. They would always be looking for a cheaper provider.

It would be difficult to determine who would try to go direct to the customer while hiring said person to haul a load.

Well using a broker for a free sales lead to a customer can hurt you.Maybe not by a broker,carrier agreement might go after money don't know.but what is more likely to happen is if your trying to soliciting freight from a broker that your loading for you need to remember that shipper has a better relationship with that broker he just meet you he probably talks to the broker several times a week.if the shipper mentions that your trying to get freight that broker will stop loading you.so how important is that broker to you

Impossible to determine beforehand, but when a carrier tries to go direct to our best customers after hauling a load, the customer will let us know

And........Carriers will Continue to do so, Is it right and ethical? Absolutely not!!
but Why do Carriers do this?? Its called "Balancing the risk" Carriers get aggravated QUICKLY when 3pl's prove dishonesty and try to "Operate" a carrier ,for example,Those Less than Stellar Broker/Carrier agreements who only benefit a broker, And Said Broker will not agree to "adjusted" agreement by said carrier,.,..
That's just a Small Beginning to The Number of Reasons a Carrier will Back Solicit..
Risk....Since most brokerages are Asset less...The Carrier also gets frustrated with that too, on top of the fact the Brokerage wants to be on the Carriers Insurance as additionally insured,LOL, So they can benefit on said Claim??
Many Carriers view a broker as,..Like you say, A person Leading othes toi freight..Once the Carrier see's the Opportunity to secure it, They do it without a second of sleep lost...Again,Is it right? No, But its the way it is.
As for Loyalty from the customer...Sure,Any ethical customer will notify said Broker of their actions, UNTIL The Customer Learns of The Brokers Practices..then it can get interesting.
Me Personally- I Wont Back Solicit-If your 100% Honest with me from the start- Once I Find out any member of your brokerage team has lied (mainly on rates) I not only Break our relationship...I Go after your customer Hard and heavy with no Sympathy or remorse. Of Course,Thats if the customer is even worth the effort.
Stay Honest with your carriers...(No Hidden agreements,Lies and such) And Most carriers will be ethical with you. Its how it works.chimbotano and CaseFreight Thank this. -
I just want to put the info I posted earlier out there for newer guys who were reading this an earlier poster said he picked of a few customers that he had loaded originally from a broker or I'm guessing that's what he meant.im only a 1 truck operation.i deal with what I think are really good brokers they are small tho.I just wanted to make sure new guys understand you get a load from a broker be careful about going in there and talking to that shipper about running them direct.You could not get that customer and lose a good broker.
