Something stinks to high heaven here! For one thing, we really aren't given a whole lot of information, from that article. (Imagine that...)
The roadside breathalyzer is just one of a number of roadside tests, conducted in any normal DUI traffic stop.
There is no mention made of the physical coordination tests. There is no mention made of the driver's physical appearance, or of his mental capabilities.
What it sounds like to me, is that there is a bit more to this story, than was printed. (No, couldn't be, could it...)
I'm looking at this and thinking quite a number of different thoughts here.
Was his "erratic driving" witnessed by the law that stopped him, or was the stop made just on the claims of this ABC investigator?
Isn't it more likely that he was either texting, or otherwise had his attention on something besides his driving?
Is it possible that there was observed evidence from the arresting officer, that either didn't make it into the report, or that the DA's office dropped the ball on submitting to the defense?
It is really difficult for me to believe that this case ever went past the district attorney's office, unless there was a whole lot more there than we are led to believe. As I said, something STINKS here. -

The article doesn't make any sense unless the D.A. is holding an ace in her pocket. However, they would have to provide any evidence for trial to the defense through discovery. It sounds like Solano County is fighting to protect themselves against a civil suit for false arrest.

Or he was not at fault? Perhaps, the ociffer was not paying attention texting and speeding, looked up after pressing send to find the driver (who was pookie from new jack city high on caffeine) had merged into her lane. Which of course prompted her to break hard and pucker a half dollar size hole in her pants suit quater roys. Which then enraged her to 1984 two minutes of hate proportions.
