Dui on caffeine

    Has nothing to do with black lives matter. I'm talking about how families and lives are ruined over someone smoking a plant that is VERY WELL known to be relatively harmles.
    There are a many people who have a big problem with someone smoking a relatively harmless plant on their own time in the privacy of their own home.
    Those people empower crooked agencies and open doors for ridiculous laws like this.

    And that is the hell of it. Without more information, there is no way to tell. I'd sure like to try to follow this story, but don't know if there will ever be anything more printed about it.

    It made the local TV news here. In the segment (from a news station local to the incident), they said the prosecutor thinks he was DUI on something they don't test for. Ah... good luck with that.

    Good luck finding a jury of 12 to convict the guy for doing something nearly everybody does on a daily basis. If this guy DOESN'T exercise his right to a jury trial, he's an idiot (or needs a better lawyer). I'm sure all it'll take is a motion to dismiss and the judge will toss it...if the DA doesn't drop it first to avoid the embarrassment. The news coverage, though, almost guarantees that the prosecutor will at least try for some sort of plea deal...which the guy is an idiot if he accepts. No jury in the world is going to convict for DUI when the only substance showing up on a toxicology report on a blood sample is caffeine.

    Normally, I'd say you're right, but, remember where this is playing out, also the land of the 9th circuit......I hope the guy's got a sharp lawyer....

    Even in Calif---ya, I just can't see a group of 12 people, most of which hit the Starbucks, McDonald's, or SOMEWHERE along their way into court to grab a cup of joe, will convict a guy for driving under the influence of the substance they ingested that morning while driving to court...and that is probably available for them to drink WHILE deliberating as to whether the guy ought to be turned loose or convicted. I refuse to believe people are hypocritical enough to convict...even in Calif---ya.

    Well if the lawyers and judge consumed coffee or soda that day I would declare it a mistrial as the prosector and judge are under the influence lol.
