Can contracts be posted?

    I have a contract from a big company that I would like to post in their area of the forum, this would allow potential employees to know what the specifics are before they decide to accept employment, would this be allowed to be posted? It's a blank contract, no driver info, just company

    Pardon the lawyer speak, but it puts the forum in a legal grey area if you ask permission to post content that an employer might not like, instead of just posting the content, so I'll say this: TruckersReport is a platform for drivers to share information and learn from each other's experience; we encourage members to post any information that is truthful, helpful to other drivers, and can be legally shared.

    Hope that's good enough for you. If it were against the rules, I'd tell you very clearly not to post it. ;)

    You can write a crayon on paper imaginary contract and then invite us to pick it apart. It would be a game or exercise to enjoy for sake of conversation.

    Now if you took say a contract that is binding and active today and posted that in it's entierty, there is a good possibility somewhere in that Contract is what is called a NDA, a non disclosure agreement not to reveal anything about said contract to anyone.

    The Internet has become less tolerant or lack of a better word easier to prosecute people who break the law online. (IM not talking about your basic moderating, but actual law enforcement showing up at your doorstep to arrest you for a post or two that was a crime and has happened to many people by now and continues to do so)

    Another path is to talk about what a good contract can have in it. Those might eventually help others to negotiate a stack of things in their favor and break the decades old ability of Motor Carriers to thrown down two feet of paper and demand you sign this now without reading it. Only to find out to your tears and regret 6 months later you are lawfully TRAPPED. and cannot get out.

    If memory serves, Wise One's main reason for starting this board, was to encourage information to be passed from person to person. I believe he even named the company that screwed him over. I won't post that though, because it could have been in a PM, rather than on the open forum.
    But a person really does have to be a little careful about how they post. We've all heard how words are like a river, once they start on their way there is no stopping them.
    Of course with the internet, once something is put on line, it can come back and bite you.

    Most of us don't. But now and then you get a newbie that does. And there's a lot of us, including me, that tend to put out a bit too much personal information at times.
    Then there are folks who post their company and their truck number.
    I sometimes wonder how many career ending posts have been put out on line.

    Just a little FYI, companies frown on that and they may complain about it to the site, demanding that you get banned.

    There is a question whether this is an employment contract or an Lease contract? There is also a different.

    However speaking on both, the problem isn't with the contract but the person who doesn't ask for a copy when they start to work, it is a right of theirs to get a copy and examine it, then ask for legal advice about it.

    If a company refuses to do that, I would never work for them - ever.

    We get company complaints daily. In most cases, they are wanting to have posts or threads deleted. Frequently, they threaten legal action against the site to get what they want.

    I can't recall any specific case in which a company has demanded that a member be banned, but I suppose anything is possible. If that were to ever happen, members can rest assured that it just doesn't work like that. We don't delete posts or threads just because companies threaten legal action, and we certainly would never even consider banning a member for posting the truth about a company.
