Companies can and do charge drivers with preventable accidents despite not being ticketed or found at fault by the police. A safety review by the company and them coming to the conclusion that the accident was preventable is the prerogative of the company as well as reporting it as such to DAC.

The deck is stacked against the CMV driver because you should be all seeing and all knowing before your tires start to roll as far as the company is concerned.

I asked the safety boss at USX when I worked their just what they considered a non preventable accident to be? The reply was, when you are parked between two white lines and another vehicle hits your truck.

 

What a crazy thought.

If the truck had moved to the right to avoid the pickup, and then the pickup suddenly moved back to the shoulder, the truck is being driven illegally on the shoulder.

Bad move. Period.
