New Line Transport is a Big SCAM. This company misclassifies all drivers as owner operators, when in reality you are a company driver, with no say in pay, loads and no independence, like a real owner operator. they make unauthorized deductions from your pay without your knowledge. This company is listed under a fictitious name as New Line transport, but it is really Cemex. All managers and supervisors are Cemex employees. They have you sign an illegal contract and cause the driver all kinds of financial hardships. This is the transport division of Cemex. This company is bad news and is in the process of being exposed

What makes the contract illegal, and why would someone sign an illegal contract in the first place?
LoneCowboy, Pintlehook, Broke Down 69 and 1 other person Thank this. -
My guess would have to be not knowing what exactly it is that makes said contract illegal.Lonesome and passingthru69 Thank this.

Just another way of keeping the Teamsters out, I would imagine.

The contract states that the driver is a independent contractor, but that's not true. The driver is an employee of the company and the company control's everything the driver does, the driver can only work for the company and no one else, the driver cannot use the truck unless it's in direct business with or for the company. The driver cannot have a rider in the truck unless approved by the company, they pay you what they want to pay you and the driver has no say in the matter, they lease you a truck, that they don't own themselves, they are leasing the trucks from another party and charging the driver 250.00 a week at 12 percent interest. Illegal might be the wrong word for their contract, but it sure is a big fruad, SCAM. Read what happened in the case with the FedEx drivers case. This company is doing the same thing by misclassifing it's drivers and having them under a fraudulent contract. The FedEx drivers won a class action suit for 280 million. Check it out for yourself.

ChillyMoeDee
Would you please put up a link to fedex.
ThanksLonesome Thanks this. -
ChillyMoeDee may have a point here, if it can be proven. It sounds like a lot of the usual whining we normally hear but you have to remember: there is a huge difference between a W-2 employee and a 1099 contractor, and a lot of small businesses try to act as if they don't know it. This is a common form of tax evasion; it happens far more than you'd think, especially in trucking.

There's a whole subcategory on FedEx lawsuits in Google regarding the issue (there are some lawsuits still pending in several states) but FedEx tries to settle them as quickly as they come because they know if it ever goes to a trial (especially by jury), the court will have their **** in a sling.

Last edited: Feb 3, 2017

Well, the question still stands; Why would someone sign a known illegal contract?
-
Read the case out of California, it settled for 228 Million. Also read Alexander v. FedEx Ground Package System No. 3:05-cv-00038-ECM(N.D. Calif. Also Donald E. Carlson V FedEx case out of Florida. Case no. 8:05-cv-1380-SCB-TGW. Also go to the national law review and read the case on 3P Delivery Inc. in there Driver misclasification case. The company settled for 2.25 million with the drivers. These are just a few of the many cases where compines lost millions trying to cheat driver's and the federal government on taxes.
