as a new lease purchase driver..
when i signed on . I was told that running north and south wouldn't be a problem, { i live in Michigan
and want to run to the south and back up }
i was also told that i could book my own loads from various brokers...
now that I have been here a few weeks,this company is treating me like an employee and company driver and trying to run me under a forced dispatch and will not allow me to broker my own loads..is this legal????
main question..... is it legal for a company to treat a independent contractor as a company driver or a employee,????? i pay the fuel..i pay the ins...i pay the plates ..i pay for the maintenance on the truck im purchasing..

How well did you go through the contract you signed? That will spell out what they can/can't do. And if you turn down loads they'll likely starve you out so they can get the truck back and have someone else make the payments on it.

A little more details would clarify. Are you doing a lease at a carrier under their authority? Doing an outside lease purchase and then leased onto a carrier? Doing an outside lease purchase with own authority?
As far as i know, you cannot transport loads outside of the carrier you are leased on to unless you have your own authority.Diesel Dave Thanks this. -
He can broker the lds, if they allow said broker on their list. Now if they have their own freight to cover. Guess what is going to get lded first
Now as forced dispatch, read your lease agreement, which you should of from the start before you even signed it

lease says nothing about forced dispatch... they said it is not forced dispatch.. the brokers im setting up loads with are set up with us.. i have gotten a coupe loads from them already but now they say i cant do that..after them saying i could,,, the contract i have is to purchase the truck..

A lease does NOT make you an independent carrier. A lease makes you more or less a company driver BUT you get suckered into paying all the expenses. Like mentioned above, did you read the lease contract ? Did you specify in the Lease Agreement what you wanted ? Also like mentioned already, if you refuse loads, they will starve you. These company's that do leases didn't just learned the tricks of there trades to paint you a pretty picture.

I was forced dispatch with a paid off truck. The only say I had was whether I go or not, not to where. I did not pick lanes. It was in the contract and it was legal. They just could not force you to go where you don't want to go (by Constitution LOL). So you can either go or stay. Forced dispatch sucks and should be avoided, it is very humiliating and beyond diginty for a truck owner to be pushed around the map.fargonaz Thanks this.

WOW. You should go independent with your MC#. The additional cost to be added is about 1000 (per month) for increased insurance. You will get to choose where, how, for how much and what freight. Freedom. But expensive a bit. But you pay it all almost anyways.

Sorry, you are a company driver that unfortunately is paying for the truck payments, maintenance, fuel and other above expenses you listed. What does it say in your lease agreement/ contract. If it states no forced dispatch, run where you want, I would bring that up to them. Unfortunately it probably doesn't. So.....Dharok Thanks this.
