The point is if Walmart was on paper it would have allowed the driver the flexibility to take a nap and not be fatigued any more.
So if that was the case one person would still be alive today and most likely the crash would have never occurred and the lawyers would have nothing to subpoena.
Elogs at the very least we're a contributing factor to that mans death.

That's like saying if there was no speed cops you could drive 130 mph and be through Phoenix before rush hour traffic .

Montana used to not have a speed limit. I even drove through there once without issues. Just because there isn't a set speed limit doesn't mean you can't or won't get a speeding ticket if you are driving like a tool. Actual data suggests the roads were much SAFER without a set speed limit: http://hwysafety.com/hwy_montana.htm

That's funny, how about paper logs. How about the driver thinking it was good idea to drive 800 or something from home to work. Then get in truck and work a full driving shift. People want to blame that on ELDs that just crazy. Walmart now won't hire a drivers that stupid. You have to live like 200 miles or less away. That's accident was all on the driver.

I can dispute it all day long, ELOGs did not cause that accident in any way, shape or form.
The Walmart driver just left a Walmart store where he could have took a 10 hour break and slept.

I dont if this is possible or not. But a fatigue sensor or some kind of system that will restrict you from fatigue driving would be much more effective. 6 hours of sleep is enough for me. I shut down before i get to the fatigue state, sleep for 6 hours. I wake up refreshed and ready to go. Going with hos, i have to wait 4 hours and i will be tired already before i start my hours. People in dc, has no experience as truck driver and yet trying to make laws about safety of this business. 6 months ago swift driver fall asleep behind the wheel in a construction zone, missed a school bus with kids in it by inches. And he said his company told him to keep driving since he had time available in his elogs. So whatever you think is safe, its not. Common sense is the only thing that can fix this.

    Which is safer
Driving an extra 20 minutes to get thru town at 2000
or because some govt overlord 1200 miles away in a cubicle says your tired and must get up and drive thru the morning rush hour.
I don't understand people who want a govt bureaucrat to control every aspect of their life with a govt regulation

    Let's play a game

Payroll cutoff is Friday at midnight, you have a load that can drop all day Friday or Saturday , you have plenty of hours on your 11, 14 and 70.
You can easily deliver but it means driving through Friday afternoon rush hour traffic.

    Do you
fight the traffic and drop and grab your next load
    OR
park and take a break and wake up whenever Saturday morning and deliver your load??

    SheepDog Thanks this.
