I agree about he 4th Amendment, it don't apply. I left my Constitution in the truck but, what does apply is Post Roads. If you use the Road, you are under Constitutional law and that is why they (the FMCSA) can mandate this new law. Same reason the Gov. can mandate seat belts, drivers licenses and anything else they see fit.

Well the sad thing is large corporations are the only ones who stand to benefit from this rule making. This thread isn't a debate about the legitimacy of them or not so I'll try not to head in that direction. But when millionaires stand to make more millions off gov regulations that they themselves were very much responsible for getting passed, I see a problem.

Talk to some.of the Mercer guys. Unless they have changed, their ELD has a plug in for the data port and then uses a tablet or phone for the necessary log ins, etc.

The real money grab lies with the device makers themselves, you should see the numbers I have seen while setting up my marketing agreement. I am going to make some money from these but my supplier is going to make a killing. -

Here is the biggest reason the FMCSA wants ELD's. From their guidance:
- Provide data in a format that’s standardized and can be transmitted to law enforcement in a number of prescribed ways, such as wireless web services, USB, or Bluetooth 2.0
1. The FMCSA with the appropriate algorithmic programming will be able to analyse an entire fleet's log patterns and determine any irregularities, in minutes. They will be able to compare those trucks on ELD's with those on paper, our JJ Keller paper log scanning equipment will put it in the same format. So, when drivers with pre 2000 equipment consistently log more miles at higher average speeds than drivers with ELD's in the same fleet it will be obvious. Same with law enforcement in the field. So a pre 2000 truck is just going to put a big target on your back.
2. There are several large differences between the EOBR's currently in use that do not make the ELD standard. Example: Carrier set variables. How far and at what speed can a truck travel before it automatically goes to driving? There will be no variables when the ELD mandate is fully implemented, all fleets will be the same.
Is the mandate going to be delayed? Unlikely. Would you like to be the congressman who tries to explain to his car driving( and truck hating) constituents why he is favor of letting the trucking industry continue to maintain HOS records with a pen, ruler and a piece of carbon paper? That is ludicrious, and political suicide.
No, OOIDA should give up this fight and shift to where it belongs, rewriting the flawed HOS regulations, which is the real culprit.DDlighttruck and brian991219 Thank this. -
