Much appreciated, drivers. So. Short haul exemption may be out the window due to working at 2 different places. Now heres another curve. Duty clock starts at the 1st job.(6am), that clock runs continuous until the 14 is up ? (8pm). It would actually be in both the motor carrier's and drivers interest for a later pm start time to drive. So he takes his ten off duty after the 1st job (9am). At 7pm, his 14 is reset and able to run full hours for the motor carrier ?

Correct. The 14 hour clock would start with the punch-in time at the first job. As you describe it here with the 10 hour break between jobs would be the best way to ensure compliance with the hours of service.

I more than understand the HOS. However if I must document all work preformed for compensation. Why will the IRS not allow is to deduct the time for labor working the truck I own, drive, and maintain at a fair labor rate?

Good point. As a sole proprietor our time is valueless to the IRS. And if you follow the HOS to the letter all that time spent working on the truck counts against your 70 so in reality it limits what you can earn, double edged sword right there.

Create a second company then. You are say James Trucking llc (JT). You simply create a company James Diesel Repair llc (JDR). Any time spent working on the truck is billed from Jt as the client to JDR, so JT can then claim that as a legitimate expense.

Heck, large companies like off this crap. Creating "subsidies" in Ireland, or Cayman Islands, or wherever. They then license from said tax haven and move all their money there.
Would not hurt the o/o to use the same concept to get taxes back he actually earned.

Zvar. You are correct with your point. Heck I have worked for a few companies that do that. However my tax account advises that its a red flag for a one truck operation. Plus IRS wants to see a business profitable every 3 or 4 years. I.E. Racecars. If not they declare it a hobby not a business.

I don't know. Are you reporting to your LTL job on Monday morning tired and fatigued because your part time weekend job is allowing very little sleep?

If the part time weekend job does not affect your normal rest and sleep patterns for those days, I would see no need to let that job affect how you do your full time driving ob.
